  2. I applied for PTSD in 1999 and was denied. Reapplied in 2000 and denied again and told to never contact them again. I applied again in 2010 (ten years later) and was awarded 30% from the 2010 date. Can I file for the lost 10 years??? Thanx, Slowlane
  3. Somehow I never got the message about the importance of getting your disabilities documented in your file. I ASSUMED that everything was noted for me. Well, I got the message now and I'm making sure that everything is noted, scheduled, examined etc. I am also going to cover it on the outside with IMO's.
  4. Your IU looks good to me if you are not working. If you have enough evidence in your c-file and your history of appointments and treatment they may not need to see you. I have had 2 C&P's this year and was never informed or invited to either one. 2 years is mighty long for a PTSD decision. Do you use Ebenifits? sorry, bad joke. Slowlane
  5. Thanks, Fiasco, I do have to make one concession: Everyone else that I have dealt with in the VA medical system have been highly professional, helpful, respectful, and honest.

  7. So this is great....How do you get the VA to measure you in accordance with CFR 38 and put it in your records??? Bribe? Threat? Ugly stick?
  8. I have a 30% range of motion condition that is service connected. I has a typed up listing of my service connected conditions which included the range of motion problem that I gave to the C&P examiner. The examiner made a notation of the condition in her write up but never attempted to measure it of give me any acknowledgement that it existed. I complained to her supervisor which was like talking to concrete. It appears that if your condition is not previously written up in your records that it does not exist during a C&P exam. I have given up on the VA to do anything other than give me pills. I have arranged to see an outside Doctor to help me with paperwork that clearly shows my service connected conditions. I hope that he will and I will have to pay for his services myself with Blue Cross's help. If all goes well and I get some good honest paperwork I will attempt to shove it up my VA Primary Cares inbox. Anybody got any better ideas? Thanks Slowlane
  9. They only got one programmer trying to fix the system and he has a keyboard with no numbers or letters on it. They are in the process of buying a new keyboard but it has to be approved by the head of purchasing. He's on leave this month. In all honesty I just got into ebennies after several trys and got to view all of my information that is (as usual) wrong.
  10. This is good information to me as I cannot get a clear answer from Pegger or Ebenies either. My current VSO is very sick and I have been handling my claims and replies myself.   13. Thanks for the info 71M10......I'm pretty sure they have received my additional claims and evidence but whether it gets combined with my original (in process/gathering evidence) claims or not. It would probably take a weegie board to figure that out. Thanx Slowlane
  14. Even tho I have already sent this stuff in by mail.....you say to fax them everything....would it confuse them with 2 copies floating around??
  15. I talked with Peggy yesterday. She said my 526b was recieved on 5/15 with new contentions. She would not elaborate nor explain. I further asked her why nothing was showing on Ebenies and without making up a lie she said its probably early yet. I will call back every 30 days and see if there is anything new. Slowlane
  16. I sent in a claim with 5 items on it to the St Pete RO over 2 months ago and cannot determine if they will ever got in the system or not. They do not show up on Ebenies and Peggy is not sure altho I am scheduled to talk to her again next thursday. Arnt they supposed to send an acknowledgement that they are working on it???   18. I have made a trainwreck out of this. The RO is about half way thru my C&P and I have submitted 4 items for secondary claims. Now I realise that I have at least 3 more items to claim (because I assumed that they were residuals and would be automatically picked up and considered). All this because I did not know the difference between residuals and secondaries. It's not fair for somebody with frigging neck cancer to have to learn this one dumb mistake at a time. Thank you all for getting the "FILE A CLAIM" point accross to me.
  19. I have already been service connected for the neck cancer......and......I have just recently had a C&P that was as short as they could make it. I did however manage to submit a list of what I considered to be residuals and they actually got typed and included into the C&P exam. It's possible that the VA only wanted to know if I still had active cancer. If they determine that it is still active I guess that they will continue the 100% schedular for a while. If they determine that it is not active I guess at that time they will get serious about the residuals and schedule more exams. My original question is what is the difference between residuals and secondarys???? If the VA ignores my residuals because they consider them secondary.....Im gonna lose a lot of valuable time submitting claims for secondaries simply because no one knew what was what.   20. I had Radical Neck Surgery for larynx cancer also radiation and chemotherapy. They removed my sternomastoclieoid (sic) muscle, spinal accessory nerve and jugular vien. It really screwed up my range of motion and strenght in my right shoulder. Now the question: Would the VA condider this a residual or secondary claim? Thanks, Slowlane

    Residuals

    I did not have a laryngectomy or partial laryngectomy I did have 35 radiation treatments to the pharynx area for larynx cancer and 3 large doses of Chemo. I am currently clear and in remission but, the residuals from the treatment were and are devastating. Everything I listed is directly connected to the cancer treatment. I think you are right that it is difficult to know how they will rate some of these. Maybe I should have put my questions out one piece at a time instead of a full blown shopping list.     Residuals

    I'm currently receiving 100% schedular for larynx cancer Agent Orange. I will be reevaluated soon and "Rated on residuals". I'm wondering how much these residuals amount to? 1. Scars from "T" flap radical neck surgery. 2. Loss of Sternocleidomastoid muscle. 3. Loss of Spinal Accessory nerve. 4. Loss of right jugular vein. 5. Hoarseness. 6. Loss of Thyroid gland (still there but fried) and on meds for life. 7. Permanent Tinnitus from Chemo. 8. Peripheral Neuropathy. 9. Loss of Saliva glands. 10. Depression from cancer treatment. 11. Hearing loss. 12. Constipation. 13. Major Range of motion problems with right arm and shoulder - dominant side. I may have forgotten a few more but I also have problems remembering things too!!!   24. Thanks pr I have a considerable amount of residuals that I am being treated for so, mabey they are waiting for me to stabilize before rating me.
