I have had 5 different C&P's. 4 of them resulted in lies and denial.

I have done a DRO hearing before (on a different item) but it was a predetermination hearing that can only be arranged in the first 30 days of denial. Thats where I got confused about the first 30 days. Harleyman saying to file for an increase........How do you do that to a active (less than one year old) denial without it being a NOD? I think the best thing to do is entirely erase this thread and start over. How does a normal veteran without computer skills even attempt to get compensation? AI got 3 Vietnam Vet buddies that wont go near the VA at gunpoint!

Lets see if I got this right.........I file a NOD before the one year limit and ask for a DRO hearing. At that point I will have more "new and material evidence". If the DRO denies then I go BVA.

CFR 38 says you cant use age for disabilities. So, now you can?

I would try to get everything moved out of Florida to Mississippi because you live there. All your data in one place is worth the trouble and if you had to visit the St Pete RO it's gonna be a long walk.

Harleyman Thats a lot of information and it's all good......thanks. I'm pretty sure that I got the typical "low ball" on my CP exam. I see my shrink monthly and I take the meds. The most current (last three) Blue button reports entered by my shrink were 45/50/50 plus other items indicate an easy 50%. This same data was sitting in my file when I had my CP exam so, why did the examiner not look at it or use it? It's too late for me to see a DRO because my 30 days have passed. You said: "If you were to file a claim for increase for PTSD ( which is what you say you want), I would wait until I was close to the end of the one year mark on the current decision. That way, you will be filing for a claim for increase within the one year time frame. Because it's been close to one year since your rating decision, and it will be right at one year since your last PTSD exam, the VA will order a PTSD review exam for you as it is near the one year mark since your last exam". This would be a NOD right?

After you have been denied an increase in PTSD you have 3 options. 1. DRO hearing. 2. NOD. 3. Start a new claim. For me, #1 DRO is too late (its been about 6 months). The choice between 2. NOD and 3. Start a new claim needs consideration. If I file a NOD it make take 2 or 3 years to get a decision. If I wait 6 months I can file a new claim and with all the emphasis that the RO's have on rapidly processing the claim I might get an earlier decision. Am I overthinking this?

Looks like the majority of your stressors came in civilian life. The shipboard fire sounds a bit spooky tho.

I requested a copy of my C-File several times and was totally ignored. This time (about 3 months ago) they jumped all over it. They treated it as a claim. Even had it on E-Benifits as a claim. Opened and closed in 3 or 4 months makes their numbers look good. I call it cheating. They also cheat by arbitrarily denying claims when they get old and put the Vet on the treadmill. A request for a C-File is NOT a claim.

After you cruise this site for several days or weeks you will discover that you are the "norm" or you are more informed than most of us.

Your sweet little song about how great the VA is will change when they revisit you for reduction and severance. You will think they are the Mafia then.

Make a real good Picket sign and stand in front of your regional office day after day. Enlist others to join in and help. This is the only thing they understand.

(C-File) Got a letter from the RO today 6/29/13. They finally acknowledged that I requested it. They said that I am in line to get a copy as they work them in the order that they get them.

The Pensacola C&P Doctors are like robots. If it's not in your records then, it never happened. They seem to be on contract by orders from above to ignore anything wrong and to minimize anything obvious. They have no shame.

Have you tried something like a Verison mi-fi instead of the satellite? Worked for me. Slowlane
