  1. If you work and have children and get TDIU does the VA go on the federal poverty guidelines as far as how much I can earn with two kids that won't effect my benefits?
  2. they did me the same way. They never told me about that I could get ES TDIU when i got out the service I was rated at a 20 back disorder i applied for SSDA got it due to my back etc....I asked for an Increase to determination by SSDA they denied me. I guess I didnt use the correct words
  3. Thank you all, Its been a long battle without war....to get benefits lawfully owed to me. I am hoping they don't put no tricks in the bag to having to have me do another appeal. Seems when I win two things they take something from me.
  4. Thank you for your response. I haven't gotten that letter either, yet. My Local VA office claims to be the fastest state in processing claims (Lincoln Nebraska). I even called my DAV service advisor, now he out of the office until the Sept 17, 2018. I will send ole iris an email. What is the white house hotline?
  5. I am a 100% disabled veteran, At first I was super excited to find out I am getting retro pay for back benefits to 2006. But that was over 2 months ago. I been waiting and waiting and calling to ask them wheres my back pay. They first told me "one month" than I call again. The guy started reading a script of basically "we are malingering on paying you" type crap. I was wondering if there is any number I can call besides that 800-827-1000 number to inquire about my status. I don't know why its taken so long when there is specific information telling them from the judge that VA owes. There was a remanded to see if I was eligible for IU (I get it now since 2014 im actually 90% with 10 of that been IU). I been on SS since 2004. Can Someone help me out? Thank you
  6. On July 31, 2018 I was granted an earlier effective date back to 2007 to 2014 (that when I got my 70% and got my TDIU ). The judge sent my file back to my local RO office, granting me to 2007 and remanded for an earlier effective date for TDIU. when would I get my retro?

  8. I am confuse....because I thought the rules said " YOU HAVE TO HAVE SERVED OVER 90DAYS REGARDLESS" (sorry for the caps)...to be eligible to receive a certificate?

I went there to that website before coming here it doesn't tell me specifically about a person being 100% ...it only states; *If you do not meet the minimum service requirements, you may still be eligible if you were discharged due to (1) hardship, (2) the convenience of the government, (3) reduction-in-force, (4) certain medical conditions, or (5) a service-connected disability.

I got an honorable discharge it wasnt a medical discharge (at least it doesnt say it on the dd214) but I was discharge because of my back....SO DOES THAT MAKE ME MEDICALLY DISCHARGE? Which will that make me able to get "A HoMe Loan?

  16. Today I received a brown envelop of my BVA decision that was remand, reversed and vacated by the CVA law judge. My othopedic doctor after considering all the history etc. conclueded that my current disabling chronic lumbosacral spine of muscular ligamentous origin with symptomatic spondylosis conditioni was related to my in service chronic mechanical low back pain injury and spondylosis of the spine Basically, the bva law judge granted me service connection for lumbosacral spine spondylosis that was incurred coincient with service and that the criteria for service connection lumbosacral spine spondylosis have been met under 38. u.s.c.a 1131,5103,5107b,38 c.f.r. 3.102, 3.303. I have, since i been out the service been recieving SSA benefits due to my injury from service and secondary injuries like Fiberomlya ......and other diasonsis My question is now.....that my case has gone back to the region office to the rater...How would they rate me being im fully disable....and when will I get my retro pay etc....... For many years I havent receive anything so im dont know what I will get and when I will get it................Please help
  17. Yes , I got an IMO years ago. My file is basically complete as far as evidence. They have all the SSDI information, they have a IMO and an Update examination report from SSDI doctor othro saying that my back condition is still there and I recieve disablity for it........ My case is now at the DAV national. they say they making sure theres no errors and they are looking at my best interests....... Yes, the CAVA judge revereseed the decision that the bva error in the presumpation of soundness and remand to see if i met the third which is "if I am now suffering for the condition first dianogsis in the military. Which I am and to why I am recieving disablity On top of that...my case has been "advance on the docket" for health reason and money issues.

I guess i making progress CVA claim was reverse in remanded the reversal was for the presumption of sounds and the remand was to see if I was still disabled from the condition that incurred in the military ( which I am I receive social security for it)...my case was also advanced on the docket as well....now...my case has mandated...and at dav national office getting look over........My question is, how long do I have to wait now??? I been waiting for years I been waiting over 10 years

  20. Thank you for your quick response Breta. what happen is my claims for cue and back injury has been ongoing for years. Its at the bva right now. I been out of the service for years as well. If you go read my old postes you will see that I been fighting over benefits for years. What happen is about 5 months ago I realize that the C&P exam doctors since i got out of the service reported on their reports about me that my congenital condition was there before i went into the service. But when they the order xray, mri, and ct scans of my back the radiologist was saying I had no congenital back injury at all, period. So theres a major error on diangonis me since i gotten out. But I didnt notice that the radiologist report until about 5 months ago . I did send a statement to the Bva about this major error as well. I was denied because they said that the congenital back condition existent prior to service. When I got out of the service I immediatley apply for benefits for ssdi i didnt get approve until 2002. For the same injury which is back injury and depression
  21. I went in the military got out because they said I had congential bitlateral sponylisos that wasnt cause by the military saying it was something I was born with and wasnt cause by military. After I got out I went to the Veteran hospital and did a c&p exam for benefits the radiologist report doesnt show this congential bitlateral sponylisos (through out the years I had mri and cat scan they to didnt show congential bitlateral sponylisos in any reports) I was just made aware of this not having this a few months ago. So I filed and sf-95. What can I do? I am on disability since through social security since i been out the military. I been denied alot of times for military benefits. But like I said, I just got wind of the error they made on the report. Also the doctors reports states but radiologist says no.
