  1. I know, and i really don't remember telling this doctor that i had it in high school. On one of my medical reports it said i thought i had it. i do not talk with my family and i really don't remember this or every taking the medication. i know its going to be a hard road but we will see. Another thing is, i don't remember this but its in the record i just was falling apart at work and my mom told me when i was younger I had add and recieved medication and it hrelped me in school. It does not state this in my medical record and I do not remember any of this. One mtre thing is my mother suffers from several mental condition and is competly out of it. i have no docotors report or anything to bakc this up. Hell, my mom who i hardly talk to doesnt remember even telling eme this but she is so out of it now. I guess i'll talk with dav and vso and see what is the best action to take.
  2. I don't rember but i guess i told the doc i had it in high school. They denied me on my claim, i'll atach decision I think this is complete bs also, since all mental conditions effect each other. I would do really good at work then have break downs and go to the mental health.
  3. Here is my bi-polar nexus letter from my civilian phyctrist that i have been seeing for 2 years. After reviewing medical records provided by Mr x from his time in service, it apprears to be almost a certainty that symptoms of bipolar disorder, depression, and anxiety started in 2002, during him initial time in the service, related to the increase in security and military activity following the terrorist attacks in 2001. The nexus letter says symptoms, i just caught that after i was denied but i'm not sure the reason for denial. Do you think that my claim was filed wrong, what i'm saying is that is says bi-polar with depression, anxiety and paranoid psychosis. A review of your service treatment records from dec 1, 1999 to may 30 th 2006 are negative for treatment or a diagnosis of bi-polar with depression, anxiety and paranoid psychosis. I do not have bi-polar in there but I have depression and anxiety issues in there. How can they say there are no records, I picked out the ones sent them via mail, vso, and ebenefits. i was crazy sent everthing 3 times 3 ways.
  4. God been through hell and back twice.. not going to go into details. Brief history 10 years military 6 years honorable and 4 years OTh by admin board for a civilian conviction. I was not given a c p exam for any of my conditions, my wife has tricare and I have been seeing navy/ civilian phyc docs since seperation. Here is just some of my medical evidence, my honorable ended 2006. I was still on active duty 2008 had a sleep study done and this is what the front says. I have tried to upgrade it didn't work out. i think they can still use this plus i have conditions like this listed in my honorable period of service. Mr X came to louisiana sleep diagnostics for an evaluation. He presented complaints of loss of energy, irritability, and short temper, anxiety and depression, trouble concentrating, mood and behavior changes, heavy snoring daytime somnolence, heartburn, dry throat, and an irresistible urge to move his legs while falling asleep, leg jerking, waking feeling partially rested or completely unrefreshed, a deviated septum and heartburn. He is currently using Flonase. His Epworth Sleepines Scale score is 8.
  5. The records are not lost and I sent them in three different ways ebenefits, vso, mailed them in everytime.. My smr for my honorable period has anxiety, depression, went to the doc three times I would do really good. I would go from the ep sailor to the guy thats was messing up on everything.. I went to medical everytime this happened... i sent in these records.. I think they just pushed the claim through.. I have a nexus letter for my bi-polar and two civilian docs diagnosis me with ptsd from service. I worked security duty during 911, was shot at downtown naples sent in buddy letter, and i severe physicla alterication with 3 tow truck drivers in naples italy and went to medical. All it has is a picture of my black eye.. I have tons of evidence in my honorable period.. I will appeal, I just hope it doesnt take 3-5 years. I'm in bad shape, I can't even get out of bed somedays
  6. I need some of the experts, I tried to im Berta but it didn't have option. I need to know how to file a cue and if i should, they just pushed this claim out and it has a million errors. It even says i went to court martial and have a bad conduct discharge. It was a civilian charge and i was given an oth at an admin board. My nexus letter for bi-polar is not in there, I sent it three different ways vso, mail, ebennefits upload. i am just really pissed off I have civilian doctors that have been seeing me for over two years and they god medical opinions without sending me to C P exams.. Thats bs. Am i going ot have to wait 2-3 years when I have all the evidence i need.
  7. HELP!!!! Ok, got the BBE it has so many errors and i havent even read the entire thing. my mind is jumping all around. bi-polar with depression and anxiety. i am not sure if i claimed it wrong in the begining or thats how they do it. I have symptoms of all in my honorable period and it states that none are in my smr. It also says i was never treated for adhd and i was and have medical records to prove it. Bad conduct discharge, I recieved an OTH and i never went to court martial. it was a civilian charge, they just through this claim together. I did not recieve one C P exam but they have a doctors opinion in my claims, but they do not have my doctors opinoin or list his nexus letter on my bi-polar. i need help from the experts. I have several break downs listed on my honorable period of service, there is one that i say my mind is jumping around alot and i can't focus at work, depression.. they listed me chronic anxiety 2008 my honorable ended 2006. This is complete bs. What the quickest way I can fix this, they straight out say I do not have evidence in my smr, i put the pages together myself sent them through vso, ebennefits, and i mailed them a copy.. i was crazy, they probably hate me..lol i sent all evidence three times..
  8. yes, i applied tons of evidence.. I was still denied by board of review. If you look at my medical records, I had years of break downs. I would go on periods where I was the top guy won alot of awards, then i fell apart. I went to medical a few times over the years and I told them this. I will just wait for the BBE, to come. I don't need my oth to be upgraded, all my symptons are on my 6 year honorable period. They put bi-polar with anxiety and depression, I am not sure why they didnt put anxiety and depression seperate. I had both on my honorable and in 2008 they put anxiety as chronic on the SMR. I will just wait, I had all the evidence and nexus letters and have been seeing shrinks and on meds this I got out in 2010. I worked for a year then fell apart, i appolagize if i'm all over the place. Some days I can focus and i'm fine, other days I can't even get out of bed. Its one big nightmare.. When I get manic, I do crazy things.. i know with help of this site, friends and family i'll make it.
  9. I am still waiting for my BBE, but I have read on here that appeals can take years. My ptsd and bi-polar are so bad, i havent been able to work in over 2 years.. i am getting worse and my claim had all the information in my service record of break downs, mind jumping around not able to focus and a nexus letter for bi-polar. Ptsd, I had worked security duty during 911 and after, in Naples italy. My biggest one was being shot at down town and I had a buddy statement to back this up but wames not given a CP exam. I have two civilian doctors i have been seeing who gave me ptsd diagnosis. I'm glad i won 50%, but i really cant work.. hell i have a hard time just making it through the day. I know some of you have been there.. i hope someday to snap back.. anyway, i have a social security claim in on appeal from alj.. At least wife, is active duty and sticking by me. Its hard when you're with someone who wont leave the house hardley at all and forget about walmart.

  12. 2008 during my oth period i finally get a sleep study done here is what it says. I know i have to wait for the envelope to come but in 2008 my honorable ended 2006. They marked me chronic on anxiety and anxiety order nos. What I am asking is, I told the doc all of this can I claim it as secondary to sleep apnea. I had some serious issues going on and thank god this guy wrote it down. I mean yes is says short temper and anxiety.. I am not going to tell a doc this unless it is really serious.   13. I was wondering if anyone knew, what happens if you have sleep apnea but can not sleep using the cpap. I don't think the VA can lower you're rate or take it away, I actually think they should increase it because you can not get what you need to be fully rested. Always any feed back is appreciated.

  15. no c p exam for any condition i will udate everyone with my paper work as soon as it comes in. Thank everyone, I would never had made it without you guys and this site. I have been in bad shape for years, after 10 years in the Navy I lost everything. Now, I am getting my life back peace by peace.

  17. yes i will up load my nexus but the nexus is not what made me win. The letter actually is no that good, I had complained about breathing, broken nose before service, sleep, at least 8 times over 3 years on my honorable period. I was diagnosed with the sleep apnea 2 years into my other than honorable period, which the va had deemed dishonorable for benefits. On a side note, my wife is active duty and I have by the grace of god had medical insurance to be able to get another sleep study done and the civilian doctor to write the nexus letter for me. Also my ptsd and bi-polar docs are both civilians. SLEEP APNEA NEXUS WORD FOR WORD This is to certify that MR X was diagnosed with OSA in 2008 with AHI of 6.9 PSG on 2-8-2012 also showed AHI of 8.3 per hour of sleep. Mild Osa is noted with complaints of daytime sleepiness. Regarding his military service in 1999-2006. It is highly probable that his current condition of OSA was present at that time, especially given his complaints of loud snoring wife's witnessed breathing pauses and excessive daytime sleepiness that have been going on for the past 14 years.
  18. I will scan the letter when they come in. I tried to get my OTH changed and they denied me. The va also deteremined the oth was considered dishonorable for va purposes but i qualified under my honorable service. I do not think that i will be able to get the oth updgraded, i tried already and i think i had a year to appeal and that has passed. All claims and medical evidence for claims are on my honorable period, so i'm going to have to wait for the envelope and appeal. Advice on appeal will be appreciated, should i get an attorney? My VSO, was only helpful in giving me an example of a nexus letter. I have read haddit almost everyday for over a year. This site, is amazing and makes me tear up sometimes. I love the support that is here.
  19. thanks that makes perfect sense, i'll wait for the envelope.. claim went from notification to finalized in one day.. I had so much stuff on the ptsd and bipolar and nexus letters.. I am surprised i won on the sleep apnea because i was diagnosed on my oth period.. but I complained and was scheduled for an appointment for sleep study but work change missed it.. I probably had 8 complaints over 3 years and a few mentions of sleep apnea in there. Two years into my oth i finally got a sleep study done.
  20. I finally won today on sleep apnea. I filed the claim july of 2011, but on the ab8 letter it says effective date december 2012. Does anyone know why? Will I get paid from july or december? PTSD lost have two doctors diagnos me but are civilians. The Va won't take me because my second discharge was other than honorable. I won the sleep off of the honorable discharge, all my claims where based off of the honorable period. I will appeal and appreciate all the help this site has given me.

  22. I went from notification to claim closed today on ebenefits, how can i see on ebenefits if i won.
  23. i would contact the aclu or some veterans group and see if they will file a civil suit or something pro bono
