Yeah J just thought maybe someone like Berta might have her crystal ball working. I have been working on this hearing loss claim for 5 years now and just DXed with PTSD last March so seems like evrything wears on me. We got a bunch of snow in our area. Snowed for over 24 hrs without much of a let up. I did something stupid and even though the wife told me not to and just pay one of the kids to do it. I went out and tried to do it myself. I have had two heart attacks and I guess I learn after the next one. I am so depressed rigght now because I can't ddo it anymore and worse than that I do thing I should not. sorry for the woe but i had to get it out! Again Merry Christmas to all! Stillhere (for now)

In talking to my RO on friday last week they told me that a current claim that I have in has had a decission made and is with the ppost determanation process? I also asked about my hearing / tinintus claim that I have sent in a form 9 and asked for this to be sen to the BVA. That appeal has been in since June 09 and she said something to the effect that because I sent in more supporting evidence that it was up for decission. Now before I get me hopes up that this is finally almost over what should I expect? 1. A complete award from the RO with no need to go to the BVA 2. A second SSOC denial. 3. A reopen of my claim and waiting for a decision or another C&P which my last one waas in 83. Would appreciate any comments. Thank you, stillhere PS Merry christmas and Happy New Year to ALL!

I would think that would be pyramiding because you are already 100% heart and the icd is for the heart correct? In any case I will bump this up and maybe you will get a few more responses.

Well don't take me wrong please but I have tried since this first came out with finding forgiveness for our government their stupidity for spraying this crap on and around all of us! I was in nam in 69-71 and really beleived we were doing a good thing and often told that to the few Vietnam people that I came in contact with. Call it the naiveivity of youth but I have struggled with the governnment saying they did not mean to spray anything that would hurt their own troops, and that it was the fault of the improper mixing and spraying and storage of all the stuff. If I understand it correctly we are or our government is trying to right for what has happened since/ In the vets case the government not the drug companies are trying to right the wrong. Maybe not as good as we want but still trying. We have to remember we were at war and the price of war is often devestating to the country that the fighting is in. There is no way that the Vietnamesse are going to win this case unless it is political. What and how would wars be fought if every where they were fought the invading or in this case the helping country was held responsible for their actions? The vietnamess had the right to cancel the spraying whenever they wanted. While I wish all them well, spraying the stuff probably saved many GI's at least for a while. Now 40 years later we are being hit by so many things that whenever another presumative is added I don't celebrate. I wonder what is next for me. I started with DM2 and then PN hands and feet and then heart attack. just recently DX with PTSD and still have hearing loss that the VA refuses. Maybe after we are all dead and gone the government will really discloae what they did for the historians. But I would doubt seriously that they would admit this to our enemies at the time.

I have not gotten even one GAF score in the past seven months. I have a Vet center visit and PCP same day Wed. 25th I will ask what is up. I mean not even from my VA shrink.

I am rated 60% with a left injection reading of 47 and it is sc secondary to DM2. Thanks a lot Berta and hope others benefit from this. Not sure what FTCA is bout I have service contected for the heart back to 05.

Berta, The original C&P I beileive I will have to go back and check. The tread mill stress was in one place and the xray in another and the doc evaluation in still anther. Yes actually I went to my private PCP and the nurse gave the ekg and the doc when he saw it had the office call the ambulance while he was giving me nitro. Once in ER (private) I was enformed I would need a emergency cath to see how bad it was. When I came to I had two stent! No I did I did not appeal my 06 decision. Thanks for looking at this!

Berta, This an interesting subject. QUESTION IN MY CASE I applied for heart/chest pain in 2003. The VA gave me a walking tread mill stress test C&P and denied my claim stating that I did have hyperlipmedia and HBP but no DX of heart disease. I APPEALED FOR A DRO REVIEW AND THEY again denied and soc said basically the same thing.They did not give me a C&P that time. When my DM2 got worse I again filed for chest pain (had been to ER acouple of times and they could not find anything. This time they gave me a C&P but no stress test. I received my denial in June of 05 although they did increase my DM2. In oct. 05 4 months later I had a heart attack (actually 2) over a weekend but did not go to doctor until Monday afternoon and the damage to my heart had been done. I filed again in Jan.06 and this time the VA gave me 60% for heart disease but only back to the date of my heart attack. Now my argument is the VA never gave a cath even after I was still complaining of chest pain. My heart disease per my cardio doc was evident long before then. WHEN I finally had a emergency cath it showed I had a 100% bolcking in my left disending and a 70% in my right. Do I have a 1151 claim or a case for an EED?? Thanks for all your help!

My reply would be more difficult. I went to it I think the day after all the changes and tried to find BVA decisions ended up having to do a search for BVA. Used to be able to click on on the right.

Berta, When I had my MI and subsuquent echo test and stress test I would notice that my private cardio doc did not have CAD mentioned but did have Ischemic on my test results. The VA then took this and in my claims folder it says CAD so I agree this should be interesting how it plays out. I also remember a retired rater state that if the veteran died of a heart disease and had HTN listed the DIC claim would be honored. It seemed to me like he was saying almost anything having to do with the heart was felt by the VA to be connected. I will see if I can find that statement.

I met with my cardio doc today by chance for a follow up to a stress test. I asked him in his opinion since I had a heart attack in 05 could I have I had IHD in 2003? He said no one can say 100% but it is more than likely that you did. Do I have a claim under nehmer??

Wonder how many cases they each hear a day. I heard somewhere that each judge does 10 hearings a day. Anyone hear this??

Thanks John that is what I thought too. I will check with the VA on the informal claim as you suggest. My paper work does say I applied for heart disease secondary to Diabetes caused by AO. So I am hoping that Nehmer will pertain. I am also as I mentioned I think going back to my cardio doc and see what he thinks. This has been a good discussion thanks to all!

Yes I am already SC at 60% for Heart disease secondary to DM2. I will have to go back and see if I actually put in the words caused by AO. But I did claim chest pains in 2003. Thanks for the question and answers on this.

Hi Berta, I down loaded it way back when you posted it on line. I just need to find it on my computer. I guess it all is going to depend on if VA is going to allow Nehmer on this condition or not?

Hello again Berta, I just got off the phone for a half an hour beleive it with my VA regional office. I really wanted to know how the VA was going to apply the new rules on the IHD but the nice lady went ahead and put in an informal claim for an earlier effective date for me. In 2003 when I was granted DM2 and PN I was also granted a noncompensation for HBP I guess that means 0%. I have only been given a stress walking test with and ekg and that time and a chest exray nothing else. I know my blood work showed hi choelstreail reading and that was about it that I can remember. When I appealed they just denied with the same material and sent me a SOC. I will have to go back and look at that. I still have not been able to track down the Fast Letter for the Heart Disease if someone has that or knows where a Link would be appreciated. Thanks again, Stillhere

Hi Berta, in 2003 I was granted DM2 and NP with ED which brought me to 40% I was denied Heart disease. I took this to NOD trying to get the heart secondary to my DM2 the VA denied my NOD In 2005 June. In Oct. 25 of 05 I had what my doctor called two heart attacks over the weekend and damaged my heart by waiting to go to the ER. I filed in Jan. 2005 and was awarded ONLY from the date of my MI and not given any retro at the time. I think the heart disease was there back in 2003 but I only had VA docs at the time and they all said I was healthy and said the chest pains were from pulling something in my chest!!

Ok I want to throw this out there and see what kind of discussion we have. I am total 80% now I filed for DM2 and heart disease at the same time because of heart pains I was having. The VA denied my claim after their C&P of a regular stress test and a chest xray. I appealed all the way to a NOD and was denied the final time in June of 05. In October of 05 I had two heart attacks and ended up with a couple of stents my heart attack was attributed to CAD. I filed again when I felt better in Jan. 06 and sent all my docs from the DR, and the hospital and the VA granted my claim at 60% but only back to Oct.05 when I had the MI. Now that IHD has been recognized as presumptive can I reopen my denied claim from 03 and ask for an earlier effective date for the Heart Disease? Anyone know? I did see a poet on here where the Fast Letter had been sent to the ROs anyone privy to what it said??
