I have been away for quite a while (couple of Years) mean while I have had a couple of operations that tended to knock me down a few notches. My appeal is at he court waiting on a ruling. My attorney filed my brief today so hope some kind of decision will come soon. I am hoping for a panel of judges to review my case and send it back to the board as a remand and set aside of their decision. Not real sure on my changes but my lawyer filed a very good brief on my part based mainly on my inability to follow their rules due to my PTSD and many disabilities already service connected for. Good luck to all. Stillhere Oh by the way I am still meeting veterans from Vietnam who have not filed and yet have DB2, heart disease and others that are covered!

Have not had the will power to come here after receiving my DENIAL on Jan. 16th. Long story short the BVA denied based on grounds that for my attempt for an EED I HAD TO FILE A CUE! They even went back and said I was notified of this in my denial of my NOD at the RO! I should have listened to Berta when she said give them what they want. I wasted time with having so called doubt in the favor of the vet recommended by others here and am now paying the price I guess. Anyhow going to be filing the CUE soon and a little confused on should I file to the RO or to the BVA? Thanks, Stillhere By the way I would like to add that the decision was mine and mine alone so no hard feelings I went the way I did after looking at the both sides but the VA only looks at there moronic way of doing things! The evidence is there all along but......!

Well had not been logging on to BVA for a few days because my appeal was stuck in the Administrative case processing mode since 12/4. I was very surprised when checking this morning and seeing appeal complete since the 1/13/2016. Now I am very nervous and waiting to see where it goes from here. From reading other posters it seem it could be just about any kind of Hodge podge of a direction! My rep is the AL might call them but probably nothing there yet, might have to wait until Monday for any news! If ebenefits is showing correct is there somewhere on the site to check and see if my EED has been approved concisely? I have never understood why they just say completed and nothing else? Oh well any opinions on where I might find out something appreciated! Stillhere

In my opinion I see no reason for the BVA actually! Our claims should be handled by real courts and subject to regular laws that are general used in any malpractice type or injury court. The hocus pocus that the BVA is the only way to help vets is as much BS as the VA health care is the only health care that should/can treat veterans! Our country needs to stop treating veterans as a totally different society. We are as much if not more a part of our country as anyone and should be judged that way! Stillhere

IF BVA is going by docket numbers for decisions then you have a wait coming up so get in line. We all hate this wait time and think (apparently wrong) that once our hearing is over and transcribed it should be close to done. But then we come on here at Hadit and find many other vets in the same basket and waiting! MY hearing was June 3 has been looked at and bounced back and forth between VLJ and case processing for the last several months! It will get done BUT only when the BVA says so!! Stillhell

Out Of Pain Meds

I guess I am living a blessed life! Every month I have to send me PCP a note asking to have my pain med refilled and usually because it has to be signed for it comes by UPS in like 2 /3 days. I also have a back up script for tramadol just in case they mess up. Pete I use myhealth evet to message my doctor and he is very good and getting back to me same day! Stillhere -

Your test does not show hearing loss. Tinnitus might be granted but that will only be at 10%. Wondering why you put in for hearing loss, when you don't have it? Stillhere- 13 replies

when I was originally appealing at the nod level for hearing loss I actually got 2 very good IMO. One of the IMO was from a audiologist who had worked at the VA and knew exactly how to word it for support. I believe it was this IMO that was responsible for me finally getting called in for a C&P and that together with the other IMO were deemed new and material and I was awarded service connection. But with only to 2009! My Present BVA appeal is for a proper earlier effective date! Stillhere -

Thanks for the great thought provoking posts! Now I am wondering if those familiar with the inner workings of the so called M-21 I think that is the VA bible. Can show some where in there where they are supposed to go seeking rebut doctor opinions of their own doctors!? I mean is this to the best advantage of the veteran for the VA to shop around looking for opinions to deny a deserving vet? This can not be SOP for the VA? I mean where is it written that IF the vet gets a glowing support from a VA doc that they go out for another one looking to undermine it! Do our congress critters know about this practice or for that matter condone it? Stillhere -

After reading a few other posts here on folks waiting for a decision from BVA. A question has crossed my mind, in my case the VA finally sent me for another C&P with QTC and after getting a copy of the report and reading how glowing it was supporting my case for hearing loss. It was then that I decided to appeal to the VA and fight for an earlier effective date. Now after watching my case on ebennies move back and forth and reading tales of others about second opinions requested by BVA. Is it possible that they are actual out there trying to get some dr to say the opposite of what my doctor and the QTC doctor opinioned?? I find that a little hard to believe and fathom as to why they would want to do that, when it was there QTC contractor in the first place! I have watched many court cases on TV as I am sure we all have (the poor Anthony trial comes to mind) where you can pay one doc to say one thing and pay another doc to say the opposite! Could this really be what slows down decisions? Stillhere -
This appeal started back in 2009 and was granted in 2012 by RO after NOD de novo appeal but date used was only to 2009. I am trying for an EED and should hope because of CUE it will be granted. Just boring sitting and waiting as it looks like we all are at something called Administrative Case Processing?! What in hell is this really? Stillhere Merry Christmas!

logged into ebennefits on the 4th Dec. and showed Administrative case processing? Had shown with VLJ since Oct. 15. So I am probably not looking at anything before the end of the year? No Christmas present I guess and surely don't want a denial!! to all my christian friends and those who believe in Christmas I wish you a very merry Christmas and a Happy New Years! to others I wish Happy holidays and a wish for Peace between religions! He should also look at filing to have his hearing loss and tinnitus reopened. Has he ever had the AO exam at the VA? If not get him in there quick as you can too! I am always surprised when I find vets from Vietnam that have not filed for AO mainly because they don't want to deal with the VA. That is exactly what the VA wants! Please tell him he earned the rights for his benefits by serving his country and get him in the loop! Thank him for his service and tell him for me please "Welcome Home"! Stillhere -
Trying to read the minds of the VA and how they may or may not handle your claim whether it be approved or not to hasten the speed or not? Is a crap shoot totally!
