  1. john999, I don't have that "white envelope" yet, and many are telling me that because I won the CUE and the IU back in January this year, and because of the amount of back pay involved, it's still too soon to expect anything this early, but those are opinions, and we all know how those work. Also, it's my understanding that once that decision is made by the hearing officer(I had a formal taped hearing), then that's it as far as approval is concerned, there is no other "boss" who can overrule it. The hearing officer verbally told me and my American Legion rep that both my IU and CUE were approved, on the spot, and I had to sign a VA form stating I would not pursue the case any further. Also know that my CUE was a percentage issue, and unique to my case. The IU was allowed because Voc Rehab, on a VA Form, stated there was nothing they could do for me because of my conditions.
  2. Working for earned income is not an option, so that's not an issue. I have another 70% above and beyond the TDIU P&T.
  3. There is no question beyond what I initially asked, I was merely adding a little more info.
  4. Buck52, I have 100% IU SMC R1, plus other service connected disabilities that add up to an additional 70%. The CUE win added an additional 20% dating back to 1990, and is inclusive with the IU, but not the 70% I listed above.
  5. It was a Formal DRO hearing. Sorry to split terms. Considering my American Legion rep at the RO is a jackass(he doesn't return my calls), can I physically go to the RO and get a copy of the decision? Will the local(where I live) American Legion rep have access to the decision? The CUE issue was settled right then. The decision in my favor added an additional 20% to my claim, and took it back to 1990. So no issues there. Allan 2-2-0 HUAH!

  7. Back on January 12th, 2017, while at a RO formal review, I was approved for T&P IU and a CUE. The approval was made during the review. Here it is 3/24/2017, and NOTHING, no bank deposit, no white envelope, no Ebenefits annotation... The American Legion rep told me the day of the review that it would be "three weeks or so", before I heard anything. Called the rep back in February, and asked him to take a walk "down the hallway" to see if my claim was ready, and he responded "That won't make things go any faster...your claim entails quite a large amount of back pay, so it will naturally take longer.....", then hung up the phone! I notified his supervisor about the incident, and still waiting for a response. How many "stops" does my case have between the RO, final approval and notification? Of course, nobody at the RO seems to be able to answer this question, is there a seasoned scrupulous veteran here who can answer it? Allan 2-2-0 HUAH!
  8. So with the IU, and having additional claims that go back to 1990 that are not included in the CUE and IU, it's not worth it to continue pursuing those claims, especially if they were claims that were remanded back from the BVA? No monetary advantage if those cases are won?
  9. I already have the SMC, no spouse. Under IU, aren't you subject to being reevaluated, whereas scheduler you're less likely not? VA took me back to 1990 on the CUE, and 1998 for the IU, so no issues there.
  10. Back in January, I was awarded a CUE and P & T IU, and I have numerous open claims that have yet to be decided, a few of which are remanded cases. From everything I've read here posted by attorney Chris Attig, you should never just give up after receiving 100%, be it scheduler or IU. It's also known that with IU, you have to declare every year that you are not employed, and if you fail to report, you're subject to getting a % reduction. So, in view of this, what are the advantages of scheduler over IU? I have no spouse or kids at home that would benefit from P&T IU. Allan 2-2-0 HUAH!
  11. Paul, The CUE was such an obvious "Error", a 10 year old could have caught it. Not only did the DRO make an instant ruling on the CUE, he also granted me TDIU as well. As I've stated, I came to the review with ALL the "ammunition" I needed to win my case(s); the DRO didn't have to look for anything, I had everything in a folder, and I had all the answers to his questions. As a matter of fact, my rep called me that same afternoon and told me that the DRO told him that in his 25 years with the VA, my case was the "easiest and most concise" case he had ever came across. DRO's, or any VA worker, all hate to look for things, they are overloaded with paperwork as it is, so if you have a review, don't make them look for anything. 2-2-0 HUAH!
  12. I requested a review in July 2015, and had my review on 12 January, 2017.
  13. Buck, I'm a true testament of the DRO route. They love it when the veteran comes in "locked and loaded" with records, medical records, C&P exams, past decision notices. And law cases that pertain to the case. I took your advice and won my cases-CUE and IU on the spot! Allan 2-2-0 HUAH!

  15. Statistics have shown that your odds of winning your case are in your favor when you allow the LEAST number of people deciding your case. In other words, a DRO versus BVA. It worked for me, and many others I had first hand knowledge of. 2-2-0 HUAH!
  16. Same here, but it was worth it. Face-to-face with review officer netted me an on the spot approval for a CUE as well as IU.
  17. Sandra, Have you let your Senators and Congressmen know about your trials and trials and tribulations with the VA? Forgive me if I overlooked it. Some years ago I contacted my Senator , and gave him a LONG "laundry" list of goof ups, errors, lies, deceptions....the VA made while handling my case. Six weeks later I got a letter from the VA which didn't necessarily admit that they screwed up, but it did point out that they would "fix" their mistakes. The following month I found myself at 80%, with no errors. Was I just lucky, or did my Senator torch somebody's ass at the VA? Both I'm sure.
  18. It's probably not a good thing to live your life worrying what others might think or do. Adding records probably doesn't take too many brain cells on the part of the VA to understand.
  19. Buck, I have ran across this problem as well. Yes, you can send in records to be placed in your C-file, but be SURE to ask for a confirmation letter that the files were added.
  20. Mark, Having a face-to-face with a Regional Review Officer is the best thing I ever did concerning my CUE and IU cases. I went in with ALL the records, all the past C&P exams, past court rulings...everything, and made sure the RO didn't need to search for anything. In a course of 15 minutes, I walked out with CUE Approved, Permanent IU Approved... My American Legion rep called me later that week and said that the Reviewing Officer told him "This veteran-me, made it so easy to make a decision..that I could only have one answer, Approved on all cases..." 2-2-0 HUAH!

  22. Rep estimated 70K alone for the CUE, and ?? for the TDIU.
  23. I don't have that "big white package" as of today, so I don't know the details of the case. If I find ANY BS with the case such as "low balling", or short changing....rest assured I will jump in boots first! Also, I do have other open conditions, 20% here, 10% there...that have been lingering since 1990. Whatever is going on, it's taking them a long time to get the "official" decision to me. I was approved on 12 January, 2017, verbally by a RO review officer. It's my understanding that it takes "3 signatures" on decisions where 20K or more is involved, do you know this to be true?
  24. Would being Scheduler instead of IU prevented the 50 from 70? asknod, actually the CUE went back to 1990, and the TDIU back to 1998.
