  1. Thanks for replying, and reading that saga. I am hoping that Dr. Whaley loses his credibility after calling my service connection not service connected, especially after another va neurologist in 2006 said it was and affecting my job significantly. They say that it was years before the neuropathy became apparent but in a discharge medical report it was reported that loss of feeling in the hands and feet is prominent when I was suffering the "atypical seizures" that were the reason for my discharge. Small fiber neuropathy can take years to show up on tests. I called it malingering because when he did the C&P he was rude and called me a malingerer. Should they have evaluated me for IU when I went to 80% in 2007? They specifically noted in my SOC that was not considered. Thanks again.

  3. My case has now been forwarded to the administrative law judge attorneys. What does this mean?
  4. Been there. After an examiner stated my disability had a significant effect on my employment my next two exams were scheduled at a different VA hospital. Two examiners said my disability was not service connected. They attempted a severance until they found out it was a protected service connection. The next exam on a remand the neurologist I had seen before was rude and condescending and said I was malingering.
  5. Be careful calling your senator's office. Your letter to the VA will be filled out by a "veterans affairs rep" and the VA will respond telling them that they are doing everything in their power to assist the veteran. You will get a letter from the rep including the VA letter and nothing changes. The downside is that your case is sidelined while the letter at the VA is getting written and then goes to the bottom of the pile.
  6. There is no specific rating that will handle inability to tolerate heat or the effects of heat stroke. With that said heat stroke/injury with a temperature reading that high can cause uncontrolled heart rate, migraines, PTSD if you have seen others die of heatstroke, and neuropathy to name a few of the disabilities that can occur. Been there.
  7. Anyone here know of anyone who had a heatstroke in the military and received benefits for it? I had a heatstroke in 1982 and was discharged in 1986 at the Convenience of the Government. Five years later I was retired by the Navy (USMC). After my fight with the government it appears that the VA is handling heat stroke and it's effects as a disability but they are not too keen on it. Curious if there is anyone else in this pickle.
  8. I am on my second remand at BOVA. I was awarded UI 100% as of 2013 with a note that a reduction in rating hearing will be held 8-17. I am requesting UI as of 2007 since this is when I lost my job. I have two civilian neurologists who have stated my service connected disabilities caused the loss of my employment. This is supported by lay evidence by managers at my previous employment. Most recently the V.A. neurologist stated I am malingering, this after he stated my service connected disability needed severance. Severance did not occur because it was a protected rating. The local V.A. states that there was no evidence I could not work. I have SS disability as of the date I lost my job due to my service connected disability. I hired a lawyer after it became apparent that the V.A. was not following their own laws. Can I expect a fair hearing at the Board of Veteran's Appeals? My case is now with a law judge. I know that the V.A. decisions are supposed to be non adversarial but I have had some really bad experiences with the local office in the past ten years.
