  1. My understanding is that the docket number does not change and once the remand gets back to the board it gets handled in docket order. My remand was held at the local office for three years, no excuse for that, but once it got back to the board it was completed in six months.
  2. I have seen leading questions when a DRO requested a C&P and while I would not accuse a DRO of lying I believe they may miss important information. That said your best bet is to post your NOD and any other decisions and let some of the other vets who have been around for a while take a look at it. With more information they can better assist you.
  3. Gastone, my appeal can be seen on the BVA decisions page now. It is Citation number 1724920, and docket number 10-13 906A. I have not received any back pay to date, I am waiting on the regional office to take care of that. The decision was positive in my favor for service connection and back pay. The remand, the second one on this case, tells the regional office they were not in compliance with the 2013 remand. I was hoping that this time around it would not take three years for them to get it done.
  4. My case has been remanded for a second time by the BVA and I was wondering if there is any timeframe for the Nashville office to start working on the remand? One of the "orders" was for back pay back to 2007 and the money would help out a lot right now.
  5. The CUE was not mentioned at all in the BVA remand. I am looking for a higher rating on basilar migraines, it was this that lost my job and the board agreed. I will now also request rating of my neuropathy. The docket number is 10-13 906A but it has not yet made it to the decisions to search. I will look for the 1986 decision.
  6. To all, thanks for being interested. The BVA just awarded UI to the date I lost my job and service connected my neuropathy. As far as the rest of the claim (for increase) it was remanded a second time for failure to comply with the board's previous instructions. I did have a lawyer and I believe it helped.
  7. Good luck with the diagnosis Buck. I went twenty years without a diagnosis of a service connected injury. The V.A. called it somtaform disease. I knew it all along but it turned out it was related to a heatstroke suffered in service. I second getting a civilian doctor to look at it.
  8. I agree fully about using a spreadsheet for figuring out what your payment will be. I have one already made out. I too am waiting for the deposit to come after being declared UI.
  9. I am rated at 70% and believe the cards are stacked against any veteran getting 100% unless they are totally out of control. You can file for IU after you lose your job, I did for my disabilities and got it but not for ten years.
  10. Thanks for the information Sir. My attorney and I are parting ways now that I am UI and 90%. I still have a remand to go through and the rating of a new service connected disability. I think I am going to go this alone now as that the DAV really messed up my case ten years ago and I am confident that I can do better by myself with some help.
  11. I am waiting for my last phone conference with my attorney. He got me to UI at 90% and will be receiving about $21,000. I now must go through more C&P's for a remand on my case and for the rating of a condition that was service connected. I appreciate that my attorney now no longer has a financial gain in my case and we will be parting ways. That is just the nature of the beast.
  12. If you are able to get a lawyer that is familiar with VA claims you might get some help, mine threatened to file a request to the court of veterans appeals when my case was taking too long on remand. Only you can decide if you want to pay a lawyer the 20% fee. For me it was well worth it.
  13. Gee, getting a civilian doctor to write a nexus letter is tough. My doctors would not touch this so I had to get an IMO. I did a search on doctors willing to write disability letters and fortunately found one in the next town over, one of the only two in the state. But do not give up, I was just service connected for a nexus that occurred thirty years ago. It was a ten year fight but I was backdated to the day I applied.
  14. I just got a great 4th of July gift. My envelope from the BVA arrived. I was awarded service connection for neuropathy and UI dating back from 2013 to 2007 when I lost my job. The Board then remanded my case for increased rating to regional to do it again a second time since it was not done properly the first time. I am still in shock.
  15. I currently have a case at BVA and was looking at my records and discovered that I asked for CUE from the Board. It is on the third page of this document.   16. I have found that a congressional is normally worthless. It is handled by a flunkie in the office usually. The V.A. pulls your case and stops working on it while they write a nice letter telling your congressman that they are doing all that they can for you. Then your case goes to the bottom of the pile. I actually had a congressman's office that was interested in my case and took it on like a bulldog. They dropped me like a hot rock after the V.A. said I had borderline personality disorder. So much for HIPA. No I do not have BPD but it was a good way to get the congressman to drop my case. I may sound a little bitter but after thirty years of bunk I am a little bitter.
  17. From all I have learned is that a remand is in your favor, except that it adds some time onto your case. The Board could have outright denied your condition on appeal.
  18. It's memorial day weekend, I cannot at this time. Funny after waiting ten years a few days is immeasurable.
  19. Thanks for the info. I found my attorney has 50 cases in 2017 and 189 in 2016. I also had to be interviewed and provide all information before he decided to take my case. My case was remanded in 2016 and he is looking for a decision this year, maybe as we write because my case has changed status this week.
  20. My case has only been remanded once but I hope with the fact that the local office has mishandled my case badly it will be decided at BVA. They tried to reduce a twenty year rating and sever a ten year service connection.
  21. I hope this means my case is out of the woods, good or bad. Maybe it will finish it's decade long journey.
  22. My case was with the veteran's law judge and within that classification it moved to the attorneys. Now it has moved again and I cannot call the VA for information until Tuesday. Any ideas on where it is headed now?
  23. Been there where the VA refused to follow the remand instructions. My lawyer asked the board to decide the case there. Now let's hope that the board considers all of the medical and lay evidence we have provided.
