Well I understand what it should be according to We vets...The VA never does anything the way they should in my claim...That's probably why this had take 46 years to resolve.. Because they have propagated a lie for this length of time.. They have done nothing more than intimidate, as well as the other VSO's, that is why I did what I did and kept filing claims for this...Sure wish I had some idea, of what they are really going to do...They attorney say's they may not even contact me for months...Then they come back and low ball you as usual.. It has been a very long and very frustrating fight...And the only reason is some butthead in the VA employ, LIED, then the dang Al, DAV, VFW kept agreeing with them...It has been extremely difficult to get them to read their own paperwork...It said in the decision that I have been awarded the maximum benefit.. Now whether or not that is true, I still am not sure I understand totally... But it also say that my EED was awarded back to MAY 7,1969, so I guess we will see what happens...Hoping they just take the 70% and make it retro to that date....Dreaming probably..

Morning Berta, I can email you a copy of the latest decision if you want...The last decision from the VARO on the CUE was 16 or 18 pages, was completely full of BS.....I scanned that as well...Remember, I keep everything....

Yes, I am Ron, and now was the word instead of no...and the one we worked on was denied.... I did another and it was denied, I finally had to hire an attorney...This was approved.. The decision says nothing but an earlier effective date was approved...It said something about Maximum benefits but the attorney said that that meant nothing..I seem to have to get 30 years of records from 69 to 91, if I don't have those he says I will get nothing...0%..All doctors and records for those years are dead and records destroyed I am sure. after 46 years of fighting what do I do..

Guess what I am asking is do they take a present rating or do they recalculate everything from that date or do they just start over requiring more disability info.. My RO is Wichita,KS

Please folks tell me something, I won my CUE with the BVA as of last Monday.. Got my earlier effective date of May 7 ,1969.. Now what happens when the VA has to pay retro back to that date.. I do not understand how this works. And how they make a determination of how much they owe me. The records say 70% from BVA decision in 08 and BVA decision in 2010 set to 100% IU retro active to 04.. The claim has no been sent back to the RO.. Now what happens?.. Please respond.. RSG

I have found that there really is no fast way to get your C-file..I have personally requested mine a few times and have been totally ignored.The FOIA route, and the form used to request your file should normally work...Is the file you are looking for very large?

I have tried 5 times over the past 2 years, filing the proper VA forms and they still have not given me a copy. of my c-file.

I have been trying to get a copy of my c-file for at leats 1 1/2 years now and The damn VA won't give me a copy...What can I do....I have tried VSO, I have tried 4 or 5 written requests and they keep gining me excuses.... The SOB's have been messin with me for 40 years and constantly lying and I am tired of it... What can I do... These idiots have screwed up my claim so bad ,lied and have caused me so much hassle....I need to know how tyo get it. will I have to call my congressman od what... I am really gettin angry.....

The VSO keeps saying they are six months behind in copying files But, I have requested it at least 4 times over the past year and a half.....

Hi, another question, I have over the past year requested a copy of my c-file and nobody from the VA will give me a copy...I have formally requested in writing 4 times and continually get ignored and get excuses from the VA. I think that they are avoiding giving me a copy because they have done so much illegal stuff with my claim...I need some help getting my C-file. I can't fight these jerks unless I can see how bad they have screwed me.....I need some help with this...TNX, Ron

Hi, yes I was denied any outpatient care in 1969, as well as all the time up until 2002. Is that 1151 claim the same as a torte claim? THey have injured me twice since 2002, both with lack of response for neccessary surgeries.. I have had 7 strokes because of them and have so much nerve damage from spine surgery that I am in constant pain 24/7/365.. It really sucks... If so I knew about that.. and yes I have documentation on everything...The BVA judgement That I recieved in 2009 specifies exactly where the VA screwed up in "69" it's all there in black and white....BVA judge quoted their errors in his approval of my service connection....and pointed out specifically where the VA made the errors in my original claim in "69". Yep, no doubt about that.... The only thing I have done is file a CUE...cause the VA screwed up royally with my claim back in 69... Big BIG errors....

Hi guy's, That veteran was me......They Va denied me any outpatient care in 1969. one month after I was discharged, (honorably I might add.) The 4 or 5 times I submitted my claim it was denied. That is what has cause me all the mental issues I have now. There has got to be a CFR or a Va regulation that will not allow the VA to deny a vet outpaitient medical care. especially when there was absolutely no reason for denying my care.....I have no taxable income...... Hi, I have a question about the legality of the veterans administration denying a veteran his rights to outpatient care. If the veteran served honorably, got an honorable discharge. Got ill in the service, got disharged with an honorable, no medical. but was discharged for medical issues....filed a claim wwith Va within 30 days of discharge for the same medical issues he was disharged for and was eventually denied any access to veterans outpatient care in first VA denial... Is that legal?anybody know? is there a CFR or something covering this issue? Tnx
