  1. You will probably be unpleasantly surprised ! I might add, my claim has taken 47 years to be resolved because of a VA employees lie.... IE. (1969)
  2. Like I have said many times about my claim as well....They had every piece of evidence they needed at the beginning 46 years ago.. I mean everything would have been in my favor back in 69, if some valuable VA employee had not, lied and caused all this grief for 46 years....As far as I am concerned they are corrupt from top to bottom..But I have a bad attitude....     Hi Berta, I have a few questions about some other healt issues I have along with what you already know about..Wondered if they might be secondary to the PTSD and depressive issues..CAn you help me with this or find info on hw the VA qualifies those.

  4. Agreed, 46 years of boot...But my CUE was established a 5/7/69 as EED.. It has now been over two months since the local VARO received the decision, and I have heard nothing.. That is what bugs me the most about this deal right now.. I guess the VA can just ignore claims and BVA decisions, until they feel like working on them.. Sure hope I do not have to file Writ or something now....Hope for the best, plan for the worst I guess.....RSG
  5. I would almost bet that your claim will go back to the BVA and be approved.. But from what I have read, any EED that has been granted by the BVA, means that the whole file will have to be reviewed again by the VARO, if it is granted to you...All I can say is it will not hurt to try to file for your EED.. Just be prepared to fight even more than you have already..RSG
  6. This is exactly what has happened with my claim.. I was granted 70% by BVA, I was granted 100% by VARO, and this, hopefully, the (last BVA decision) that I have to pursue,granted my claim back to May 7,1969.. With this as an earlier effective date.. It's been just over two months and I have heard nothing from the VARO about this latest decision..Bugs me...But I am trying to be just a little more patient now.. And I did file everything within a month of my discharge...RSG

I have been wondering lately if VARO directors get bonuses on top of their $150+ per year salaries...It would be very interesting to know......And yes, it has aroused my curiosity because I have heard nothing from my VARO since they got my decision back for my Granted CUE...Seems very weird that it takes this long for them to respond to any inquiries as well..   8. Well, Like I said, I am a bit impatient after all these years....It has only been 2 months since the decision, as of this week.....Guess I still have no right to complain to about the VA, it's only been 2 months...LOL....RSG

I have found that the VA rarely reads the important stuff in your claim file, even when you point out to them exactly where they have made a mistake..They also very rarely pay attention to any veteran..The VSO's I have used rarely pay attention either...none can read very well or understand...That is why I have a 46 year CUE awarded in my favor..All the evidence was there in black and white and it has never been acknowledged for these 46 years. They never paid attention to what I was trying to show them.. Now that I have won, I am still waiting for the VA to respond to my emails to the director.. No response there either....So that leads me to another question, how long does the VARO have to abide by the BVA decision to award a "maximum benefit" and cut a check for my 46 years of retro pay?? I am a bit impatient after all these years... RSG

Yes Berta, they are a disgrace..We should never have to fight this hard to obtain what we deserved...Especially if all the documentation is there to prove them wrong...If all this is finally completed on my claim, I intend to help as many vets as I can. Wether it be Homeless, Suicidal or whatever...If the VA doesn't help them I will do my best to help...I do not plan on leaving HADIT now that I may be able to help a fellow vet...I just needed to get all this BS from the VA sorted first......

Hi Berta, well, I certainly hope you get this sorted out..I my claim, it has been 2 months since the BVA CUE decision in my favor..THe stuff hit the fan this morning as far as I am concerned..I am contacting the General counsel as you have done in the past, as well as the Director of the VARO here in Wichita, with a letter to the BVA judgeas well..Guess we will see if this has any effect whatsoever..Again, thanks for all your help Berta, it is appreciated, as are you..46 years of their BS is enough for anybody to deal with....   13. Well, I won my CUE and was granted an EED of June 7 1969.....I have gotten no response from anyone there at the Wichita VARO.. Are there any phone numbers available for the VA employees there.. I get real tired of being screwed with.. It has never taken this long to resolve any of the past claims and Pay me my retro...Why is it taking so long now....I need some phone numbers if anybody has any....Tnx, Ron
  14. OK, my CUE was granted with an earlier effective date of May 7 1969...How long does it take for the VARO to get the info back from the BVA.. Then how long does it take for them to get the file reviewed by the VARO and finalize this Claim? I have heard it can take many months or years...Do I need to call general counsel or the director of the VA here in Wichita.. How long do I have to wait for these issues to be done....Is there phone numbers available for the people in this VARO? RSG
  15. Hi Berta, No, I have not used e benefits yet...Sure hope this doesn't take month's, bet they will weasel out of paying what they owe, or they will start messing with my existing benefits.. Just wait and see I guess.. I must be a little impatient now... RSG

Not sure if I ask this question here or elsewhere, sorry if it is in the wrong location...How long does it typically take for the VARO's to receive the claim back from the BVA, and do they have a time limit to respond.. It has been just short of a month since the CUE was done by the BVA. How long does it take for the VARO to come up with numbers for my retro pay back to 69.. Seems like they should take care of this in a more timely manner? Tnx, RSG

  18. I feel like the VA will retaliate against me because I won the CUE in my claim that dates back until MAY 1969... I think this is standard procedure...I think they are really going to start messing with me..

Yeah, the claim was all an ERROR on the VA's part...It was plain and simple, black and white, also stuck out like sore thumb...It is obvious some employee just lied...Any of the VARO's just don't and didn't understand, or chose to ignore the facts...with everything the VARO's were preaching about all the denials was all just their intimidation routine...I just did not let that happen, I continued to fight because I was right...Like I say, I don't know if it will help others, But I hope it does...

I really do not let myself expect much from this CUE now, after listening to the attorney and some of the things in this post, absolutely boggles my mind....This whole deal is getting very depressing...I am glad however that at least, Maybe winning this claim, I have made it easier on vets in the future and the VA will benefit them as it should. I would hope so, because I would have hated to go thru this 46 years of BS for no reason....At least knowing I might have helped somebody else, even with no monetary return on this claim, makes the deal go down a little easier, no matter which way it goes.. thanks all.   21. John, you did not say if you were using an attorney.. If you are not using one, I would . I know it's not monetarily beneficial. Maybe another pair of eyes would help. My attorney finally got the VA to read what is in black and white.. After 46 years of the BS and I still have to fight even though they already know they are wrong and always have been... I know now I am going to have to have another fight, even though I should not have to...The whole situation with the VA needs to change, I think they need to hire people that actually know what they are doing and understand what they are reading......

Yes they should pay interest, but this organization never does everything they are supposed to, even when they lose, the VA still makes you fight for what they owe you..When they consistently lose, they just make your life more miserable by messing with the rest of your existing benefits..The VA never proves to be fair, EVER !
  23. Yes, they are illiterate. I seriously hope these jerks do what they are supposed to, but as usual the VA makes you fight for what you earned, Even though they have been proven wrong in their decisions multiple times.. Just pisses me off when you have to do this.. I can not see ant justification or reasoning on the VA's part.. Seems if they approved an earlier effective date thru the BVA, the RO would have take those decisions and roll with it.....I guess that idea is just dreaming....
  24. Hi Berta, As far as the Claim you wrote previously, I think it said pretty much the same thing as you did, just in a more concise format.. The reason the VA keeps denying me is because they don't know how to read in Wichita, or anywhere else for that matter...That is the whole problem with my claim, is they never read it.. As I keep saying, the VA just lied right up front and I think that you know why.. They didn't think I served long enough to warrant any Benefits....I will post the decision later, I am trying to eliminate all the personal stuff.. The attorney is Daniel Krasnegor, He has supposedly worked for the VA system in the past...He is in Virginia, he says he has 11-14 years experience in the VA system.. I don't like this guy very much..
