  2. well i decided to get a lawyer as eed is complicated and i have had many claims through the years ,and finally got the award. just doesnt seem right all those years just because i wasnt informed about the rigorous claim processing rituals i had to suffer without a dime. i have been in those hospitals without a dime in my pocket and no place to go when i got released. for what it is worth i am going to use lawyers for vets michael viterna if they will have me.
  3. ok i have a question i filed for increase and also filed for ptsd among ther things . i won the increase 30%to 50%,but said even though when i went in for c and p doc on first award said bipolar, panic attacks and ptsd. they only compensate me for the bipolar and say the panic attacks are part of bipolar. now on the ptsd says since i have a diagnoses of ptsd the claim is now reopened and continueing but denied because of the stressor factor. i was a truck driver and my situation is different from a lot of people ,i was hauling ammo to artillery,prisoners,just all over the place away from my main unit. you know constantly worrying about mines etc. this last award is dated 5 may 2008 is that my eed time to start the one year . the effective date for the increase was sept 29 2008. so the claims i added should have had the clock ticking "on the one year" 5 may 2008 right????
  4. ah yes that is what we did ,especially since i cannot hear ,she was pretty well doing everything for the poa i had.
  5. that is what i am thinking berta , i won my claim the last time and the poa's were awol,when i needed them. i feel i can get enough info from hadit to present my claim as good as any poa. especially if my wife helps.
  6. just did that and i am wondering about them deniying a 1971 claim by appeal that had not been appealed in my 1987 claim i guess they saw it as possible being appealed later or something ,but is what they did right as the 1971 claim if they go by their own rules is many years p[assed the one year mark,talk about double standard!
  7. here is another thing to think about that is against me. i am trying to go back to 1987 claim that was denied and i let the one year time limit run out. i think back then it was filed under nervous condition and somehow bipolar got in there. any way i think they should pay me back to 1987 ,but i know they are going to deny on grounds i let one year time limit pass. not to mention while they were at it in the 1987 claim they took care of their butts on a 1971 claim that had not been appealed and made sure that was denied by appeal also.
  8. ok i have filed a nod and sent in a form 9 to contest my eed. i have had it with vso's and what have you. they did not do s--t to help me win my claim,if anything they cost me . because for years i thought they were working on my case and one day i called and they did not even know who the hell i was. i panicked and immediately found hadit and got the ball to rolling and would have lost if i did not interveine. now when i sent in the form 9 asked at the bottom who was representing me and i put n/a . i am thinking of my wife as my representative ,is that a problem?
  9. oh wow! my apologies t-bird i did not know you were a lady! i still have as much respect for you as ever if not more. thank you for this wonderful site. :) i cant believe i have been on here for years and did not know t-bird was a lady,i feel like a dumb-butt. this lady put together the best site in the country as far as i am concerned for veterans.
  10. i just want to say i love this site and all the members . this site is phenomenal for veterans whether filing claims or searching for info,there is someone who has the answer on this site. these people are smart and what is so good about it you can find someone who has either been there or is going there. i try to adhere to all the rules and consider it an honor to be a member. i really do not know what has been going on to cause t-bird to post his directive,but he does it for a reason and i am sure it is to keep the site on track for the purpose it was intended. if i could have had access to this site when i came home from vietnam i would have won my sc disability back in 1967 and my life would have been a lot easier. this site gave me the wisdom and encouragement to win my claim ,and if not for this site i would have failed i am sure. jmho
  11. i feel honored to be a member of hadit . i suffer from bipolar and sometimes i get off track and would welcome a moderator getting me back on track . i love this site and if a moderator sees where i am going wrong i welcome him or her to point out that fact. if a moderator says dont do this i am not going to do it. please let me know when i am not in line,i welcome it. i will quickly make amends.

  13. well yeah i am expecting a long, long wait,and i am going to represent myself or let my wife represent me. i dont expect a c and p as i have just gotten an increase . i sent in my form 9 and requested to be heard by bva in washington,they are the only ones who have ever helped me. this ro where i am at ,forget it they wouldnt give you s--t unless they absolutely had to.they have never helped me in any form or fashion.
  14. ok i have a little more explaining to do,here is how i wound up being able to appeal after the one year. when i asked for an increase after the initial 30% award i turned around and put a claim in for an eed at the same time among several other claims. so i got the increase from 30% to 50% but was denied an eed on the original 30% claim. the one year is not up on my right to appeal that decision. what i am asking for is an eed on the 30% claim and not the 50% or the 20% increase. on my award letter says march 5 2009 so i guess that was the day the clock started ticking. and at the end of the award said i could appeal if within the one year limit. had to edit this i had date wrong at first
  15. excuse my disorganized brain ,now i remember it was changed from bi-polar to aquired psychiatric. but the award is for bipolar, panic attacks, ptsd so i have to think abouit this for awhile and try to figure the best way to state my case. however i will say i think the bva has been fair with me through all this.
  16. ok here is and was my situation as i do not think i explained very well. i applied for nervous condition bi-polar back in around 1987 or there abouts. i was denied and let the one year time run out . a guy from dav filed for me while i was in the va hospital and after i was discharged i was homeless for a while, anyway i did not get their letters . so when i reopened the claim they"ro" tried to say i did not file within the one year limit and i appealed it and the bva had mercy on me and said in my case it was harmless error. so now they are going to say my eed can not go back to 1987 because of the one year clause,but if bva called it harmless error back then it should stand now. what i am saying is this has been overlooked and i am going to bring it to their attention. if the bva called it harmless error and let me go ahead with my claim i won the 30% for my eed should go back to 1987 in my opinion. so what do you think?

  18. just to let you know i know nothing about what you are describing and i in no way was trying to put you down with my chicken coop joke. i have no opinion on what you are describing and was just trying to have a little humor and have the highest respect for you rock and berta. so please do not take offense to my corny joke and forgive me if i have given you the wrong impression. love you guys and girls. feel free to take a shot at me when the opportunity comes along.
  19. ok turned out i think i was ok to file a nod on my eed. so i filed a nod and sent in a form 9 also last night. i am trying to go back to 1987 when i put in for the same thing and was denied. ok i know what they are going to try to say,case was decided and the one year passed in 1987 and that made it final. however here is where i got them i think. when filed the claim i have won at 30% to begin,it went to bva and they determined that me not filing within the one year was harmless error. i have it in writing in one of my appeals. so having that out of the way if they accept my reasoning should clear the way for my eed to go back to 1987. right or wrong???

  21. i cant see where it would hurt at all . i have had the bva ask for my social security records and whether they tipped the scales in my favor i do not know.
  22. ok sent two nod's in to make sure downloaded a form 9 filled it out and sent it in . I AM GOING TO SLEEP!
  23. ok i just filed a nod just stating i disagreed with their decision will they send me a form 9?
  24. ok here is what happened i won the 30% july 2008 and later asked for an increase and an earlier effective date . i won the increase and they denied me the eed . so this was later ,and can i appeal that decision since it has not been a year ? found it sept 29 2008 i was denied earlier effective date was granted an increase. well it says i can appeal to bva in the award.
