  1. They claim because it's a lot of money they now have to make sure we cross every t and dot every i. Who decided 8 years $25 K was the amount to warrant restraints ? I guess the V.A. can't be cheatng out of $24 K or anything under 7 years was good.
  2. I was told that my file is in suspence maybe 9-17-08. They have to do something by that date.
  3. Josephine helped me with some phone numbers, they can't understand what's going on either (Just told it's a lot of money). The hard part about waiting is to see what I'm being paid for. The awards letter goes back to 1988, 30% so it starts at $200.00 and goes up to $450.00 a month, so it appears over $70 K. (wife and 2 kids) I've read a lot of claims in the last few days dealing with eye dieases, it seems lot deal of them were denied. I prasie God I was awarded a claim, haven't gotten the money yet (20 years retro) it's been since 1 Aug 08. I know it takes 3 signatures for anything over $25 K. Seems like I'm fighting all this by myself. V.S.O. told me I would never win, lawyer never came through (gave some good advice, but never presented my case). The S.O. thought it would take about 10 years. I filed in 2006 awarded in 2007. Filed a N.O.D., S.O. said file an appeal, got my congressman involved, he sped things up I presume, DRO deteremined I had filed in 1988 so awarded a C.U.E. hence the retro. It's hard trying to find out which angle to approach, trying to plot my next course. I had a corneal transplant in 1994 and had a rejection on the surgery. I was off for 3 months and then had stitches in my eye for about 9 months which I had to go back every month to have removed before I could start wearing contact lens again (I have to wear them, but can only do so for about 4 hours each day) My vision is terrible without them but I can't get a rating beyond. So I'm trying to get a temporary disability rating of 100% for that. Don't know if I'll get 1,2,3 - 12 months or nothing for that. Also trying to become a V.S.O. myself so I can help other veterans as well. So 4 reasons for posting this time. 1.Trying to get others with cases like me to respond. 2.Help with the next step 3.To help others 4. Never gave real info on myself So here's a bit. It's hard to share a lot of info, All that "Enemy of the State" stuff worries me sometimes, so forgive me. I'm Former food service guy. Feed a lot of pilots in my time and a few generals as well, been all over the world, feeding in tents, makeshift buildings, flight lines, for humanitarian efforts, special award ceremonies, satellite facilities, passed out quite a few C-rations. Even had mourtuary duty on occasion. It was a pleasure feeding you guys and hearing your stories while you ate and defended our country.

  5. Does anyone have any information on this alternative, what was determined ?
  6. I have other posts regarding this issue but here it goes. I was recently awarded a claim going back 20 years. So I guess this is a recent rating decision. During that time I have surgery (corneal transplant) and was out for 3 months. The transplant rejected and I had stiches in my eye for 1.5 years and could not see properly (or returned to my best corrected/post operation vision) until after they were all removed. I didn't know what they would grant me and how to proceed. My Veteran Service Office and the service organization working with me haven't really helped. Both thought I would never will my case.

  8. Thanks for all your help Berta, It's a matter of interpretation. (By the way forgive me if I make typographical errors, I run a spell check but somethings I miss because I can't see sometimes). I would like to have someone explain the rating system for my condition: For example if my left eye is rated 30% I have to wear contacts (the the minium rating is 30%)for keratoconus. To have any increase they have to look at the other eye. Say I loss my right eye, It would take me to 100%, if my vision is corrected to 20/30 in the right eye, I'm still at 30%. The problem is I also have keratoconus in the right eye and I have to wear contacts, so why not give me the rating for the other eye. They rate me for best corrected vision in right eye, the diease is not even considered, doesn't make sense.
  9. I e-mailed him and he handed me over to his representative. His representative told me I wouldn't win my case and I did. Hopefully he is better than his representative.

  11. I would like to hear stories of those soldiers with Keratoconus ratings. I'm 30% left eye. I've heard of people being rated for both eyes,that can't be true can it? One eye is considered a pair right like ears are considered a pair?
  12. My over $25,000.00 claim (20 year retro) is still with the rater waiting a supervisors signature since August 1, 2008 Still being patient and trying not to spend the money before I get it. I heard my file is on a desk at the bottom of a stack. I still feel special lol B)
  13. Thank You Berta, I think I read every last appeal on that website (searching only relevant information of course)while compiling my case. It seems most were denied beyond 20%. I got the 30%. It would be nice to talk to someone in a forum that has also won a claim. B)

  17. I won a 20 you retro claim and I'm trying to figure what they are paying me. I guess I should be more patient, I just can't believe it until the money is in hand. I need have things in order in case I have to file something else. I have several post that I can't get answered. I'm at 30%, some of the monthly rates go up and down so I'm confused. I also had surgery in 1993 so I'm also trying to figure how much time I can get as a convalscent rating (100%) I was off for 3 months but my vision was very bad for about 9 mos. So any information is greatly appreciated.

Looking at my awards letter says something like this Monthly entitlement amount / payment start date / reason for change $450.00 Dec 1, 2006 Cost Of Living Adjustment $489.00 Jan 1, 2007 Gross Rate Additional Amount $450.00 Feb 1, 2007 Gross Rate additional amount $489.00 Dec 1, 2007 Cost Of Living Adjustment What does the Gross Rate additional amount mean ? It the amount $450.00 plus $489.00 for that month?
  21. Any help in this area would be appreciated: I know someone has recieved a Convalescent rating in the past. What actual information is required in for a Conalescent rating. I had surgery for my service connected claim back in 1993, didn't file at the time. Had outpatient care, bed rest for 3 months. I have the doctor's note stating as such, surgery failed. Had followup care for about another 6 months until I got better. § 4.30 Convalescent ratings. A total disability rating (100 percent) will be assigned without regard to other provisions of the rating schedule when it is established by report at hospital discharge (regular discharge or release to non-bed care) or outpatient release that entitlement is warranted under paragraph (a) (1), (2) or (3) of this section effective the date of hospital admission or outpatient treatment and continuing for a period of 1, 2, or 3 months from the first day of the month following such hospital discharge or outpatient release. The termination of these total ratings will not be subject to §3.105(e) of this chapter. Such total rating will be followed by appropriate schedular evaluations. When the evidence is inadequate to assign a schedular evaluation, a physical examination will be scheduled and considered prior to the termination of a total rating under this section. (a) Total ratings will be assigned under this section if treatment of a service-connected disability resulted in: (1) Surgery necessitating at least one month of convalescence (Effective as to outpatient surgery March 1, 1989.) (2) Surgery with severe postoperative residuals such as incompletely healed surgical wounds, stumps of recent amputations, therapeutic immobilization of one major joint or more, application of a body cast, or the necessity for house confinement, or the necessity for continued use of a wheelchair or crutches (regular weight-bearing prohibited). (Effective as to outpatient surgery March 1, 1989.) (3) Immobilization by cast, without surgery, of one major joint or more. (Effective as to outpatient treatment March 10, 1976.) A reduction in the total rating will not be subject to §3.105(e) of this chapter. The total rating will be followed by an open rating reflecting the appropriate schedular evaluation; where the evidence is inadequate to assign the schedular evaluation, a physcial examination will be scheduled prior to the end of the total rating period. ( B) A total rating under this section will require full justification on the rating sheet and may be extended as follows: (1) Extensions of 1, 2 or 3 months beyond the initial 3 months may be made under paragraph (a) (1), (2) or (3) of this section.
