  1. As a reminder my recent retro check over 25K required 3 signatures before approval and took 45 days even with direct depoist. Rest assured when it finally does come, you suddenly walk around with strarge music in your ears causing you to dance, then you realize because it's taken so long to finally have money you've been doing without a lot of stuff and stuff costs a lot more than you remembered. Treat yourself nice but save a lot of it, you can't go through the same season again, then come back and fight some more. God Bless You!
  2. I asked for a copy of my c-file on August 4, 2008 (right after I was awarded my last claim) it came on 10-22-2008, I guess it's good to have it, didn't seem like anything missing. I simply asked my VSO to get me a copy, he asked me to right down something about a privacy act and 2.5 months later it's here.
  3. Thanks, my VSO called yesterday and told me to send in the letter. I mailed it yesterday.
  4. I wasn't rated at the time (original claim 2006). The military went back and gave me an earlier (1988) effective date. Surgery 1994. I am just trying to figure out how to submit the info, do I file another claim or just send in the medical evidence and send it to whom?
  5. My claim has been awarded and closed and they missed this part of my claim. What form do I need to submit for a temporary 100% disability rating for a surgery? Someone told me the answer before but I can't find it.

  7. Prefectly correct on the Kookie reference. They say I should get my money next week. I had to call my congressman again. They say it hurt me by a week. Whatever.

  9. Congrats to you. :( Waiting is hard. 20 year retro payment 30 % (about 39 days now). I know my case is unusal (Under success stories). I am still doing research plotting my next step. All I hear from the V.A. is it's going to be big. I think they are trying to add in my convalescene rating. I had complications after surgery for 2 years, so I need to see how they handle that.

  12. 1 Aug 08 awards letter issued. Tracer on the Check ??? What check, should be direct deposit.
  13. Berta, Is there anything else that can be going on, My V.S.O. (American Legion)says he is powerless, 40 days and counting. I do have direct deposit. I got a check for the 30% on 1 Sept 08. Yes- anything over 25,000 needs 3 signatures-he is right- was this an Agent Orange claim? That could account for the fact that -regardless of the older denial decision-they had to pay you retro back to that date-if the disability you claimed is the same one you have now due to AO (Nehmer Stipulation) I am assuming a lot here- if this is NOT a AO claim maybe they CUEd themselves on the older decision- The decision will say it all- start to watch for the mail or check with your bank if you have direct deposit-in a few days-the claim,once signed off, will go to Finance and they usually work fast- I always got a check in the mail before I even got the award letter.   16. Mine didn't have the 15 day notice on it. I did recieve my normal deposit on 1 Sept, so the account is good, plus I check with the bank everyday. Thanks for all your help. It will probably happen in a few days.

  18. Found it I think Protected Evaluations Under 38 CFR §§3.951 and 3.952. Care must be exercised to avoid violation of the protective provisions of 38 CFR §§3.951 and 3.952. Measure the 20-year period of 38 CFR §3.951(B) from the earliest effective date of the combined or individual evaluation(s). For purposes of determining whether benefits were received for a continuous period of 20 years, include periods during which recoupment or deduction applied to an award. If a retroactive increase under 38 CFR §3.105(a) results in a veteran having been rated for 20 years or longer at a certain level, that evaluation is protected under 38 CFR §3.951(B) and may not be reduced in the absence of a showing of fraud. A veteran who renounces entitlement to disability benefits will not accrue protection under 38 U.S.C. §110 and 38 CFR §3.951(B). Ratings for other than compensation purposes (ancillary benefits) do not accrue protection under 38 U.S.C. §110 and 38 CFR §3.951(B). Protection under the provisions of either 38 CFR §3.951 or 3.952 of a total rating or disability evaluation(s) does not preclude reduction to a hospital rate under 38 CFR §3.552 or discontinuance of compensation under 38 CFR §3.557.   19. Where do I find out about the 20 year protection rule. Once again forgive my typing errors. Sometimes my vision comes and goes. I hit spell check but somethings I miss.
