  1. My 2.5 cents, never saw a VMC DR PCP or DBQ say anything about the Vet recording the Exam. You can ask, what's the worst you have to face.

    My tale with requesting and Recording my 06/2014 DRO Appeal Official Hearing.   Before the DRO began to swear me in, I asked about the DRO's Failure to respond to my "Official request for an Informal Evidence Conference" in 11 or 12/13. He acknowledged he had a copy of the IEC Request in his file folder, said we could do it before we do the Swear in, and start the Official Recorded and Transcribed Hearing. He further explained we would stay in "Informal Evidence conference," unless I wanted to go "On the Record, Recorded and Transcribed." At this point, I had already placed my micro recorder on the table and asked his permission to Record if we went on the Official Hearing, being recorded and Transcribed. Without hesitation, he immediately gave me permission, however, advised me historically the Transcription could take 9+ months before being available.   We Stayed on the "Informal discussion" for the entire 35 min. He Awarded everything from the 2010DRO NOD and said because I went Informal, he would address my 2012 IU Denial DRO NOD, even though it wasn't on the deck for the 06/14 Hearing. Awarded IU T & P No Future Exams.

  2. A-N, at ease on the "numerous ways to skin the CAT," my wife is a very sensitive CAT Lover, myself I like them fine with Garlic and chopped onion. No chapped lips during the winter.

    I probably won't show her my comments, might have to kick my arse before I get back into fighting shape. Never again in this lifetime.

  3. If you ain't IU T & P with only (1) SC listed as causing you to be IU and have other non-IU causing SC's that hit the SMC S Scheduler Housebound (60%) independent CSC, you don't qualify for IU SMC S Scheduler.

    Now if the CSC's that you currently have gets you to 95/100 %CSC based on a multitude of SCs, however without (1) SC Rated independently as 100% by itself, you will not be eligible for CSC Scheduler Housebound with (1) SC Rated as Permanent or Temporary (Cancer with future possible reduction after surgery). A friend just got his PTSD BVA bump to 70% and a Lung Cancer Temporary 100% Rating, he's not IU, strictly CSC, (1) SC Cancer 100% and the 70 PTSD got him SMC S Housebound $344.00. Other than the Cancer DX, he's smiling about the Comp. He's just didn't wait to file the Cancer AO claim like his VSO suggested. I had him do an FDC within a week of the Cancer DX, why wait, all Med recs at his VMC, Cash hit within 2 months.

  4. When you hit the SS medicare age, you don't have to sign up for it, save the $100.00. If you accept the Medicare, it becomes the Primary Payer to VA and Private Hospitals.

    A short story. One of my Bi-weekly NAM PTSD Group friends told me he would always get his VMC Medical and never sign up for Medicare. I counseled him about his options, discussed VA coverage of Private Hosp ER and post Stabilization transfer to a VMC. At the time, I carried a $45.00 high Deductable ARRP United Medicare Plan.

    Two years later, we're both in Naples FL at the same time, he's admitted to a non-VMC ER circling the drain. His wife, of course, is beside herself. He has no Medicare in place, Hospital ER jumped right on him, but the billing Dept is pushing the wife to sign up for an emergency Medicare Plan.

    She called that day, he just kept telling her to call me. We got her in touch with her Detroit VMC the same day to notify his Det VMC regarding the Naples ER information. About 2 weeks later after being stabilized, the VA transferred him up to the FL Tampa VMC by Ambulance for the remainder of his 2 additional weeks hospital stay.

    The Det VMC came through for him, the wife did right getting verifications of all contact regarding reporting the ER, all expenses covered. He was not happy about the Tampa Stay, but that was the deal, a bed was available. Post his Hospital stay, he immediately signed up and paid the late fee for Medicare and I believe he went with ARRP United Health also. About $140.00 per mos. Turns out, in the Naples FL area, there are only small VA Medical Satellites, nothing major.

    I increased my ARRP to the $140.00, NO RX, back in 2016. I still rely on my VMC PCP and Specialists for non-life threatening invasive procedures. Private RX's are filled by my VA PCP after faxing, within the hour.

    Bro I got a $3500.00 IL Dept purchased and a $1500 Lap Top with Printer early 18.

    Got the HISA Award for the $6800 Grant from IL but haven't used it yet, been busy getting myBent Brain work done.

    Apply on ur E-Ben for VA Voc Hab Appt., even though you're after IL. You are assigned a VRC who pulls double duty as VRC and ILC, works for me. After 1st office appt, a non-VA Disability County Social Worker does a home interview at the kitchen table.  Prepares multi-document list everything that comes to mind to help you, all part of the Hoops necessary.

    The VR/IRC agreed with my request for a Laptop instead of desk unit if I can't work in my Den. Took about 2 weeks.

    My IL met with me at a near Big Time Medical provider and tried every Lift Chair Available, heat, Massage complete sleep, and lift settings along, with a backup battery. The other thing was, Think its "Trendelenburg Reclining Setting" when you need to get your head below your feet edema begins in feet or legs.

    For the little time and effort, I had to put into VA IL, I think you're missing the boat to a better quality of LIFE thanks to the VA.

    I just have to figure how ALEX  (AskNod) "Obyone"  got the Greenhouse.

     

  6. Ace, your 50% for the IU, was rated upon the allowed the 3 10s and the 20sc were not included in the Reasons SC for the IU. In order for IU rating can only have (1) SC, not a couple listed as a couple extra SC's. Following the 50% for IU is now considered for the basis SC's now conclude for the SMC S (60%).

    So if a Rater allowing you a CSC of multiple SC that now rates as 95 CSC to 100% would cause you to lose the IU SMC S has to maintain by the Rater for you losing the SMC S 60%. As NOD discusses the Higher SMC L has nothing of your Need for 1 SC at 100 and qualifying for SC S.

    How about the IU Award indicated in exactly SC qualified the IU and those 60% SC that contributed the SMC S under the IU?

     

    When my PTSD 70, CAD 30, and SA 50 were listed by my SC's  in 2011 and listed on the IU, eliminating the SMC S, my bad.  When I did the 100% for SA bump Award to 100 CSC by itself, then cause the CSC (1) SA 100% and the PTSD 70, CAD 30% did the (60% needed for the SMC S Award.) The 4 Years of IU becaming moot and returned from all info pasting with New Awards 11/2016 early eed of 2012.

  7. Post a redacted of your PTSD and Tinnitus Award Letter, the Denial of your Hearing on being considered as not SC will be addressed.

    If you have a POA-VSO, ask for his assistance in helping review of your C-File, he can review your C-File via his office Computer. Have him to address the Denials of Hearing C & P Exams, request copies are made for your records.

    Ask the VSO-POA to assist you in requesting your VA C-File FOIA Request being Filed by Fax to obtain a copy of a searchable CD.

  8. I did a quick read, you have PTSD 70% Award and 10% Tinnitus.

    What do you base your Loss Of Hearing SC % if an Appeal were to change it as SC? Could you post a redacted copy of your Private and VA C & P Hearing GraphHearing Losses and your Test Word Results, 90% guessed or understood?

    Did your private ENT and the VMC C & P Hearing Losses compare results from the Hearing Testing and Word  Results, regardless of SC or not.

  9. Time for you to avail the assistance with your POA-VSO. Have VSO-POA pull your Dependant info from your C-File. The VSO Rep can file your Dependant correction on your behalf. (2) Kids would be worth approx $104.00 per each dependant after you reach 30% SC Rating. Maybe your E-Ben has all your Dependant Info already on the books, check it out.

  10. S-G, read the M21 discussing DRO requirements of completion regarding SOC and SSOC after the completion of the DRO Review or Hearing not changing the original Decision. Only the unresolved NOD Issues that continue as Denied are eligible for RO Certification for transfer for Docketing to the BVA . DRO SOC/SSOC are required prior to RO Certification and transfer to the BVA for Docketing.

    The DRO doesn't address NOD Issues that have been Awarded in a SOC or SSOC. Award info is strictly discussed on the Award Letter.

  11. The BVA Decision Clock Appeal for the CAVC Starts Ticking! Your VA lawyer should have addressed the trip to CAVC already, this is where Legal Fees get Awarded on outright Wins or Remand Decisions back to RO.

    A friend got his BVA Denial (repped by VLC, DC) for SMC K Remanded by the CAVC, Legal Fees $16K paid by VBA, his final RO Remand Award netted him about $7K for the 6-year Appeal wait.  No, For Fee legal Firm would have ever signed on to rep him, he was turned away by (2) well-known Firms.
