Can Anyone Explain ?

Question

What does it mean when the VA says "A decision will be made as expeditiously as possible."? Can anyone tell me the VA's definition of expeditiously?

I got a letter today stating that "Your calaim is currently under review by the rating board, and we are awaiting a decision. A decision will be made as expeditiously as possible."

I already knew it is with the rating board, it's been there since Feb 7, 2007. Why are they wasting time telling me what I already know? When they should be spending that time getting a decision made.

I have been dealing with them since 2000 and you are so right, they are incompetent, they are liars, and they don't give a care about veterans. I did an IRIS ON THE STATUS OF MY CLAIM and they sent me a response that was totally different from what they told me a week prior. So I contacted Senator Sessions offfice to look into the status of my claim, they told the Senator's office something totally different from what they told me. Frustrated I did another IRIS and got a different response from the response they gave the Senator's office, I printed the IRIS response and faxed it to the Senator's office with a message as to who are they lying to me or you. The Senator's office contacted the VA and the VA said the information they gave the Senator's office was the correct information, so I call the VA the next day and requested the status of my claim and was told again something different. I contacted the Senator's office and they responded later that day and told me if I don't get a copy of my decision on the 23 of this month to let them know and they will request a copy and send it to me. However, I will not be holding my breath for that decision!

Jay I noticed from your profile that you have to deal with the Montgomery VARO. Their definition of expeditiously is sometimes in the far, far future. I have dealt with them for over 7 years now and I am still looking for one of them that can read, speak and write. A one word summary for them would be "incompentent". As for the letters, I finally sent then a letter and told them to quit wasting their time, my time and all of Alabama veteran's time by sending out such nonsense. That was two years ago and I have not seen one since then (guess they took me off their spam list for snail mail). Up until that point I had received one about every 60 days. The problem I have with such letters they are simply stated by you generic pieces of crap that does not do anyone any good to include the VA. As you said they need to concentrate on training their personnel and processing claims. Some may not think that this is such a big deal but if you count all of the man hours and funds spent (paper, ink mailing cost etc....) it becomes a big deal. Lets see, 600,000 claims pending, 90 percent of them will be pending over 2 years..... Wow thats a lot of wasted manhours and money spent if they do in fact send out one of them buggers every 60 days.

Naw, Gulls and Bouys, you DO NOT UNDERSTAND.

Each VA employees' desk comes equipped with a BRAND NEW Ouija Board.

All you gotta do to play, is give them a call.

"It is cold and we have no blankets.

The little children are freezing to death.

My people, some of them, have run away to the hills, and have no blankets, no food; no one knows where they are-perhaps freezing to death.

I want to have time to look for my children and see how many of them I can find.

Maybe I shall find them among the dead.

Hear me, my chiefs! I am tired; my heart is sick and sad.

From where the sun now stands, I will fight no more forever."

Chief Joseph

Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

      In-Service Event or Aggravation.

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
    • Welcome to hadit!

There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

      https://www.va.gov/resources/getting-emergency-care-at-non-va-facilities/

However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.

When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.

However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.

That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.

Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.

Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

    • Good question.

Maybe I can clear it up.

The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      More here:

      Source:

      https://www.va.gov/disability/dependency-indemnity-compensation/

NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
