Is An Iris Inquiry Noted In Your C-file?

1. When you do an IRIS inquiry from the web and get an email is there a record of that in your C-file?

The reason I ask is that I've been instructed by my VSO to ONLY go through them and to NOT contact the VA myself. In the past (before they told me this) I had called the 1-800 number with varying degrees of usefulness and when I got my C-file there were printed records of some (but I don't think all) of my calls.

2. How long does it usually take to get written confirmation (not from IRIS just from the usual paperwork flow) that the VA has gotten your NOD?

The first time my VSO sent in an NOD for service connection over a year and a half ago they sent me a verification letter dated 2 weeks after they got it. They finally awarded me service connection but only at 50% so I sent in a second NOD for a higher rating through the VSO 6 weeks ago and still haven't gotten a letter from the VA confirming that they have received my NOD. Since I clearly stated I wanted to use the DRO I'm not looking for a DRO election letter but I am looking for a letter verifying that they've gotten my NOD like I did with my first NOD.

Also, the VA, in the past, keeps transposing numbers in my zip code. That is part of what my 1-800 calls were all about. The last correspondence I got from them had the correct zip code on it but hey, so did the early ones, and then they just changed it for no reason so I have no clue what they're doing.

There was no record of the IRIS inquiries in my C file, but my file is with the Appeals Mgt Ctr.

The reason I ask is that I've been instructed by my VSO to ONLY go through them and to NOT contact the VA myself. Over the past 7 months, I have sent 4 IRIS questions to my VARO asking if they received my NOD that my VSO sent via certified mail in March 2007. All 4 of the IRIS inquirees were answered that the VARO has no record, whatsoever, of receiving a NOD on my behalf. I told my VSO and he sent a special request to the VARO requesting acknowledgement of receipt of the NOD. That was 3 months ago and the VARO has NOT responded back, to date.

This is pissing-me-off. :o

I recently received a copy of my C-file. A couple of my phone calls generated notes, a congressional inquiry was fully documented, but none of the 2-3 Iris inquiries I initiated were copied in the file. This information is only helpfull if we can fully believe that they sent me the whole c-file :blink:

I am thinking about a trip to the regional office to review my c-file and hand deliver a copy of the NOD that they signed for but don't acknowledge they have and to take a look at the actual file. Who knows I might find that seperation physical that seems to have disappeared(from 1987 not recent). Do you need to call ahead and schedule an appointment?

My "C" File had stuff that shocked me. My email to President Clinton in 1996 and a letter to VA from the WH telling them to hurry up and to let them know what happened. A credit report done on me when I applied for a VA Loan, information about complaints I had made on the 800 number but all this was before IRIS.

Also there was stuff that was not true at all which irritated me but I let it go. It seems that some of the people you talk to at the VA are extremely paranoid and congenital liars. Or maybe I was delusional but I am unfortunately blessed and at the same time cursed with a very good memory.

So one of the reasons it is so important to read your "C" File is that you never do know what is in it.

If the file is close to being rated you should wait till you get a decision and than ask for it.

I think that any contact that you have with the VA will probably end up in your C File.

Veterans deserve real choice for their health care.

I am certainly no claims expert, but acknowledgement is imperitive in anything, especially in today's world, whether it be a VA claim or whatever. Confirmation is everything and can burn you if you fail to ask for confirmation. Many get offended when you ask for written confirmation but it's just good business and prevents many misunderstandings later. If anyone submits a payment of a document to any person or organization, they should expect confirmation in what they received and surely that they did receive it. I think the iris system to me is one of the greatest tools that the vet has at his disposal for confirmation.

If you tell me what RO I might have their Director's phone and fax number.You could contact them directly and get this squared away.

It sure upsets me to see carelessness like this regarding our claims.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
