When you get two different letters from the RO on the same day and each one is pertaining to something different, one a NOD and the other to a the BVA, and I have already corresponded to the RO and the rep I did not want send anything to the BVA until I had exhausted all of my avenues at the regional level first, who knows. I have asked them them that question, but I haven't gotten a response yet from either. My rep took a week off for Thanksgiving and was back Thursday but did not return my call. They tell me now, he with a client and it's best to call back, instead of leaving a message for him to call you back. When I'm sure where my claim is and what the status and location of my claim is, I will post it. I would like to know the answer to that myself. Danang_1969 Danang 1969, I sure wish the elders on the site could figure out a way to keep your claim at the Regional Office, for it is so depressing and takes so much time to go to the BVA and then there is the chance that you will be remanded, for most likely something that could have been prevented. My docket year at the BVA is 2004 and you can see , if you have read my post, in the end, if I should be granted benefits, it could have all been avoided, as the Regional Office, In my opionion, should have never sent me for that second C&P within 5 months of the first one, when the evidence was positive. Been in ready to wait status since the last BVA remand for seventeen months now. Remand is for RO rating specialist refusal to acknolledge three IMO's from Dr Bash, list them as evidence and provide a basis for excepting or rejecting evidence in the last two or three SOC's. Allan Hi Allan My claim has been at the AMC thirty months and one week. I would not hesitate to call the AMC Director's office and complain. I did and my claim was rated 4 days after I called. Late Oct 07 was told I was in a ready to rate status. As of 11/27 sent to rating specialist. Please tell me that this is progress. I read Tank and Josephine's comment and it takes the wind out of your sails. I haven't had nor do I really have any additional info to send since appeal was remanded (other than C&P that was ordered, which seems to be more favorable than previous). Is there any way to REALLY find out what the wait times normally are at AMC? Hi Deesulpwr Somewhere I read that the average wait time is about 400 days at AMC, but that info prolly was coming from the VA. My claim has been there 888 days now, more than twice the average. Or I would file a Writ of Mandamus. When my appeal was gathering dust I asked for a Hearing from the BVA and the Waco VAROM thought my claim was remanded. I know that there is Diane Winston, she works with the raters. Go through Director Russo's office and bug her a while. She tries to come off ignorant, but she is quite the opposite.
