Question

I pledge to track Indiana politicians on their actions for Veterans. I am challenging others on this board to pledge to do the same for their state. Any thoughts? We can keep each other aware of what the politicians are doing and what they are not doing and publish telephone numbers when an important issue is coming up and send a message to these people that WE will not be ignored anymore,nor will we be split by our conflicts we served in, and that the voting Veteran block will stand united to elect officials that are committed to keeping the promises made to Veterans. We are all a family and WE TAKE CARE OF OUR OWN.

I signed off and my phone rang and I now have an appointment to sit down with Tom Sugar, Chief of Staff, for Senator Evan Bayh. It is next Wednesday. I'd like to go with a list of great ideas and ask him to get together with Senator Lugar from across the aisle and co-sponsor some bills for Veterans. Give me those ideas!!!

I think that the first reform that should be made at VA is that after 6 Months of claim being filed that VA would pay 100% Benefit until a final decision is made and if the decision is less than 100% the Veteran should not have to pay back. Most Veterans sacrificed a lot to serve our country and that is not to much to ask.

Veterans deserve real choice for their health care.

I have something Congressman Filner is considering -hopefully in the works-it would be nice if any Senators from your state would support it too----

I wont be talking to Congressman Filner until maybe 2 weeks from now-to get a status-

I have asked him to propose an amendment I wrote to the VCAA-he has quite a bit he wants to do regarding numerous veterans issues -and this would involve the backlog situation. He has a great track record for vets- in my opinion-

If he proposes the amendment I sure will be contacting Congressmen and women from each state to support it-

Amendments are the only ways most VA regs can be changed.

I also am gearing up for something I fear-

if the Haas decision is favorable from the Fed court (we should know within a month or two hopefully)-

there is a chance that the proposed regs could limit Naval Blue Waters to presumptive AO -only to the 12 mile off shore limit or to a new VA definition of "territorial waters of the Republic of Vietnam"---

I am a little paranoid about this- if Haas succeeds this might not even be a factor but some Blue Water Navy scuttlebutt is considering this potential and I sure advise Blue Waters to get all the log info possible if they were 7th fleet and off coast of Vietnam during the war-

just in case they have to prove what part of Blue Water they were in-

of course that doesnt make sense- but the Judge did mention the 12 mile limit in the Nov 7th hearings on Haas.

Yet a persistent organic pollutant like Agent Orange (dioxin)did not limit itself to contamination just of the 12 mile limit-

This is something that I hope our Senators and Congressman do not attempt to manipulate if Haas becomes law-

then again we dont even know if we will have any regs at all as proposed-and of course anyone can comment on them at the Federal Regulation web site-

Senator Clinton and Schumer as well as my district Congressman fully support mandatory funding-

it is the Senators and Congressmen and women out there who don't- who really need to hear from their constituents on this and get off the pot and support it-

thats why being part of one party is ole hat, everyone needs to be an independant thinker, which allows you to vote anyway you choose.

Your idea is perfect as the first reform. Let's give the veteran the benefit of doubt instead of the government.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
