Ftca 95 Claim, Bay Pines Regional Counsel

received first letter acknowledging my $1,000,000.00 claim..yea right,,anyway they said we have received your admin. claim and wish for you to submit any other info you have on injuries, etc,.then it goes on to say "we may ask for a interview or physical exam.we also need Dr. notes or IMO's, as to the nature of injury,progression,prognosis, etc,. so we may further facilitate our expeditious evaluation of thi claim..forget the BS, how, when ,why, where did they learn or incorporate the word "expeditious" into anything they touch..mmmmmmm Question? after research i came up with "ignore it" and then they'll deny, then TOO COURT WE GO! is this correct?? thanks, williamn [i filed oct 23rd]

Am I to understand you filed the form 95 on Oct 23, 2007? Where are you at in the process?

claim filed with regional, one very short conversation with the lawyer from Regional Counsel, today i received a letter from the regional counsel as i stated below,earlier. thats where im at...do i really ned to respond to them?? or just let it go and let them deny the claim and then i'll go right into court and file my complaint..?? regards, williamn

I agree with Jim. They are fishing but I feel that it is a form letter. I would not compare this type of claim to a regular claim for Service Connected Disability. You are dealing with Lawyers who have been trained to get good deals for the VA. You need your own Attorney and fast.

That's not the way it works! You are obligated to exhaust all means to settle your claim before you are allowed to file suit. That means communicating with the Regional Counsel. They will probably want more information, exams etc. You will have to comply.

i agree now.. however, im ready to proceed in court with my complaint.. their looking for any info i have on outside IMO's, legal rep.,dr. receipts,etc,.i believe that they really want to know how strong my case is, in addition to what i sent them already..Sen. bill nelson inquiry forced them to send my claim out for a Med.Review of the allegations[ the lawyer said he sent package to Atlanta,GA.[outside present VISN network].Sen bill nelson received a copy of my ftca claim and needs some answers from them by Monday..[30 days] i want them to deny immediately, so i can proceed to court, if necessary.they already know they're cooked! should i reply that i have no other info to send them and let them proceed?? regards, william

Jim knows what he is talking about. You have to comply with the requests of the VA. It is part of the process. You will have to send them an IMO and submit to examinations by doctors that they want you to see. I suggest you get an attorney. I have been through this process and even if you have a slam dunk case, the VA will fight you. Time and money mean nothing to the VA. It is more important to the VA to win. They don't care about how much money they use to try and get out of paying for what they are responsible for. The VARO counsel has done this many times. When they are done trying to work you over and you haven't settled, they'll hand the case off to the U.S. Attorney's office and they pick it up from there. The VA will take the entire 180 days and probably ask you for an extension. They'll ask you to send them info and for you to submit to an exam, they'll stall and then the first offer, if they don't deny the claim outright, will be insulting. The FTC process is just that, just like the claims process, a process and you have to prepare for it, just like a marathon. I am not trying to scare you, but I want you to realize...You just told the United States of America that you plan to sue them because of the actions of the VA. The VA is going to do everything they can to not have to pay. I suggest that you start looking for an attorney. It is a shame that Veterans can't do this type of thing on our own, but the VA uses professionals and most times, we are not a match for their seasoned attorneys. I really think you should GET AN ATTORNEY.

Without a lawyer they will spin rings around you. This is not the VA we have all come to love, but the very hard ass VA that protects its assets at all costs. It is like the COVA and very adversarial.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
