Wow a 27 dollar raise. Hey the might cover the cost of milk and eggs for a month for a familly of 5. Wait the don't count my daughter she just lives in my house and over 18 so of course I don't support her lol

I was answering a direct querry from NAm Vet 1968 about how the Amendment came out and where he could read it. I said in an earlier post that it would not hit till 2009 in 2 years and than only if the Legislature enacts it into law. Since 86% of Texas Voters voted for it one would hope that they will do it but our glorious House Leader Tom Craddick spoiled a whole lot of tax relief because of his temper tantrums last Session.

Veterans deserve real choice for their health care.

I am under the impression that the legislature has no choice since this was voted on as a state constitutional amendment, it should only be a formality for it to pass into law.

Speaking of Taxes when I left the state in 2005 the Text courts were going to decide on the legality of the application of property owners paying school taxes. Right now My school taxes are paid to a county that I do not even live in because I am right on the county line. Ironically I pay all the other taxes to bexar county. Any information on what happened in the courts?

The Courts were supposed to address the so called Robin Hood School tax where a rich school per their definition has to kick back major bucks to about 220 smaller districts who do not have a big tax base. I imagine that even though you are on the border with the County that you are in a school district that is in two counties and the school district has hired Bexar County to collect the taxes. In years past the district collected on their own but I am in same boat as you and pay all my taxes to Dallas County and they get the money to the districts they collect for.

The next legislature has to enact enabling legislation and unless the Governor calls a special session and allows the legislature to do something earlier it will not take effect till 2009. A person over 65 or carried as disabled on tax roll can elect to defer their taxes by contacting thier Central Appraisal District and filling out the proper form. If you elect to defer the tax no enforcement action can be taken and when you sell your homestead they will collect the taxes at the closing with simple interest.

First of all there are not as many as you think. Secondly if enacted the Legislature will probably subsidize or authorize some sort of agreement to reimburse the affected Taxing Jurisdictions.

Number of Veterans Rated 100% Disabled (as of 09/30/07):

249,904. In Texas last time I looked it was around 24,000 and I would guess that not all are homeowners.

Course many of our dear local politicians hate to give up a dine that they can collect so I am pretty sure some will fight against it.

If you are still curious you could call the Bexar Central Appraisal District and ask them how many 100% Veterans they have on the tax roll. I am sure that you can get the info. I once asked the Dallas Appraisal District how many disabled homeowners in the City of Dallas and they told me a little over 24,000. Of course only a small portion would be Veterans

Actually my school taxes are billed by and paid directly to Guadalupe County all $2012.56 By my mortgage company

and the rest is billed by and paid directly to Bexar County all $1920.37 by the mortgage company

I live in Bexar county so I really don't understand how this can happen.

(This is about 1 1/2 months of va compensation and really sucks )

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
