Turned Down For Increase

Question

I had a C&P examine recently and was turned down for an increase in disibility for my current rt knee problems. My current rating is 10%. I had am MRI which shows a torn medial meniscus. I have been having problems at work with my knee locking and I am unable to squat and perform my duties as I used to in the past. I submitted this evidence to the V.A. but they turned me down anyhow. They said because the evidence does not show a marked interference with employment or frequent periods of medical care an increase in compensation is not warranted. Do I have any other options available to me. If I file a NOD will I have to go back to the V.A. office and provide more evidence?

The best way to approach this is to look up in the C&P Exam Guidelines and the Title 38 CFR to see exactly what they look for with knee injuries. Those links were posted here several times, the last being just about a week ago ... but they can also be found at http://bluewaternavy.org/vsotoolboxlinks2.htm ,,,, and if the description of a higher rating fits what you are experiencing, have an outside MD check it and write you a letter using the VA's own language to describe what those higher percentage symptoms are. Submit this to reopen the claim as "new and material evidence"... this is one step back from the NOD. Save that as your last resort, because if you get into a pissing contest with them you'll need to hunker down for a long wait. Anything you can do to avoid that is in your best interest.

What would I do if I was denied an increase and reveived the same letter you received.

1: I would write a NOD. I dont agree with your decision. list your reasons.

2. Next step, Call a local ssa attrorney and ask them who they Use as Occupational Docs for IME's and how much they charge.I used one and on examination, he found additional items.

3. Get all records and Xrays, MRI"S and have an IME. Let the doctor explain the effects on your occupation.

An Occupational specialist trump regular docs or Nurse practitioners.

Submit the docs opinion.

That was the best 500 bucks I ever spent.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

Thanks for the clue, may work for me, or not. I'll need to research if Occupational Doc may upport 'unemployment' due to mdd stress. Havent had a 'job' except for few years, SGA not an issue, low pay. Also got physical issues, including knee, meniscus operation in service, knee is numb and has edema often I need increased for. Meanwhile, I try to work here and there, hoping I dont collapse from stress, lumbar or legs. Its tough to get turned down, but I have a feeling there may be hope in the spring, Lord willin' and the creek don't rise!

I never thought about that, interesting approach. Do you have to pay, win or loose?

For my children, my God sent husband and my Hadit family of veterans, I carry on.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
