Merry Christmas

Question

I just wanted to say Merry Christmas and Happy New Year to all of you. Obviously this is not the place for me. When one cannot make an innocent comment in general terms without being ridiculed, having their service questioned, or being personally insulted about the medication one is taking, then it's just too negative a place for me. Persoanl attacks in my opinion is what is over the line Pete. If any of you have a minute please read all the posts I've made on Hadit...am I a trouble maker, you be the judge. If anyone mistook my post on Betty's topic as an attack on her or her claim (which it was not) then I am sincerely sorry. Again I wish you all a Blessed New Year.

Merry Christmas to you also.

I was one that supported Betty in her claim without knowing all of the facts. After she posted the actual opinions and documents I too was wondering if she really had a valid claim. I don't think pointing that out makes you a touble maker. I think this is what you are talking about anyway.

I would not have posted what you did because I still really don't know all of the circumstances surrounding her claim. I feel that every vet should have the opportunity to try to win thier claim and if they are the reason for the backlog then the gov't needs to step up and either change the rules to say you can only appeal so many times or hire more people to do the job.

You have every right ot voice your opinion without being attacked.

Thanks and I agree, every vet has the right to apply for benefits if they feel it is justified.

gee- I didnt take any of your comments as an attack-Attack boat vet-

As a matter of fact I held a position for about a year here that was not popular here at all-or with Josphine either-

I saw no proven nexus and neither did one of our other members (Vike)who has not returned here in many months.

I feel a proven nexus could alter her whole claim by maybe get her the diagnosis she needs-

Every vet does have a right to file a claim but I also think we all have to be honest here as to the claim's merits and as to what is lacking in the evidence.

I read and re-read many times the info she posted here and the remand-and still felt the nexus -if proven- would render a psychiatrist to be fully able to do an IMO for anxiety due to service.

I hope she pursues her claim- I dont know how the AMC works-and what the next step is in the letter she received.

I thought this was over, but...

I didn't see your comments as innocent, but rather a blanket statement about the validity of claims for such "bogus" things as hemmoroids. I didn't ridicule you, I posted a well-worded rebuttal to your statement. I didn't question your service, I stated that you appearantly didn't have an MOS where hemmoriods would have been a result of your service. I didn't personally insult or attack you over your medications, either. The way I worded my comment was to say that someone who has been on pain meds long-term will have IBS with constant bouts of constipation which leads to hemmoroids, in which case that would make the 'roids service-connected. I tried to word it to say that if this was your case, then you might have a different attitude towards filing a claim on the malady. I also questioned what, in your opinion, was a non-bogus claim. Then, after I was told that I was an "anger management" case, I rethought my post and apologized to you. You accepted and we moved on.

Now, if this is how you react to an online debate, then I'm not quite sure what to say. I am sincerely sorry if I offended you, or if you took my statement as a personal attack. I hope you have a wonderful Christmas and a happy New Year.

I wish everyone a Wonderful and Merry Christmas.

This is a time for us to be Joyful.

Don't anyone think of leaving the board, over whether or not, I have a valid claim.

If I offended you when I said for you to be sure to take your Lithium, it was only out of concern.

My daughter is Bio-polar and it is just a dreadful and tragic illness.

Come back in and post.

Always and I do offer my appolegy to you if in anyway that I offended you.

Always,

Betty

It wasn't you I had an issue with rental, it was comments after your post and the apology. No worry, no problem...I got money from the VA and it's Christmas...wooohooo

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
    • Welcome to hadit!

There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

      https://www.va.gov/resources/getting-emergency-care-at-non-va-facilities/

However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.

When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.

However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.

That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.

Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.

Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

      https://www.law.cornell.edu/cfr/text/38/3.344

    • Good question.

Maybe I can clear it up.

The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      More here:

      Source:

      https://www.va.gov/disability/dependency-indemnity-compensation/

NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
