Question

Someone had a post about this recently but I forget who and I found this decision at the BVA.

http://www.va.gov/vetapp06/files4/0623407.txt

The veteran's claim for SC of GERD due to meds prescribed for a SC knee condition in 1998 was denied.

The veteran's claim was again denied in 1993.He did not appeal.

The claim was re-opened due to new and material evidence-

In 1996- the veteran's diagnosis appeared for the first time in med recs as stomach discomfort and refluex diagnosed as dyspepsia.

In 1998 an upper GI series revealed GERD and a haital hernia. The veteran had been taking NSAIDs for a SC low back pain condition which were discontinued in 1997 due to the GERD distress.

"The examiner noted that the most important aggravating factor of his GERD and hernia was NSAID use."

"Order :

The claim for service connection for a gastrointestinal disability is reopened.

Service connection for a gastrointestinal disability is granted."

Just to update, called regional 1 800 # and the latest on my Appeal for a denial on my claim for gerd seconadary was that, notation was put in the system in July, 2008 that said about the claim "it was sent for for a new decision".

Now I do not know what that means but it sounds like a decision is getting closer on my appeal.

As I stated earlier, In early 2008 my va doctor wrote a statement that my gerds was ' more likely than not' caused by my Va service connected meds, 'nsaids.' I sent that in as new evidence after my orginial claim received a denial.

I have just been subscride a secondary med to to accompany my omprazale for my Gerds and will also send that in as support for my claim as soon as I get it in the mail.

This started in early 2007, and I still cannot see light at the end of the tunnel. But, it will continue until I have something to show for it.

Any update on your claim for GERD due to NSAIDs?? My claim is supposedly with the rating board now. I will let you know when I hear something. I did get a nexus letter from my gastroenterologist a month ago and forwarded it to them and they acknowledged they got it.

Mine was re-opened based in new and material evidence, and then denied because they said I didn't have a nexus. The problem was, I did have a nexus, they just didn't look at it. So that is one of the issues I have on appeal. I am currently waiting on a DRO hearing date, but that is on hold while my TDIU claim is processed. The TDIU claim has been at the rating board since 15 December 08.

Had a C & P today, and they have schedule me for a upper GI (Barium) test next week. Not sure what it is they are looking for. I had a endoscopy done and cannot see what a barium test will show that a scope did not show...

I will be there.

Not sure how well the C & P went, answer the questions as best as I could. She did want some information that I could not supply - going back years....

She also found my blood pressure was high and sent me for a blood lab test. Said one of my counts was low, but the other was good.

I will request a copy of this C & P next Tues when I go back for the upper GI and my 2nd C & P.

On a brighter note: I will have to change my name from 3 years to retire to 3 days to retire. I leave the Post Office this Friday.

So I have 3 days to work - and one of them is my day off.

Good feeling after 31 years in Gov't service.

Thanks and will keep the forum updated

I`ve had 4 endoscopies and have gerd, hiatal hernia and barretts esophagus. The stages go Gerd and then progresses to Barretts Esophagus and then many times Esophagus Cancer. Barretts is known as pre cancerous. If you have Gerd please elevate your mattress EVERY night. It only takes seconds for you esophagus liner to burn.

I`ve taken Nexium for many years and its bull that it cures. If I miss a day or try to substitute it...I can`t stand it.

So yes john...you need it checked. I usually get it with the colonoscopy. Thats a great day..lol.

I drink everything now. After last stage tonsil cancer I said the hell with it, I`m gonna go with caffien and chocolate all over my chin.

Major disability for me and is rated secondary to PTSD...but at only 10%.
