The VA was SAYING they got the idea you quit work in 1983 to work at home from your med records. Did they mis-state those? Was wondering if it was a case where you DID try working - but couldn't handle the stress and wanted to be at home (i.e. safer, less stress) - which is totally different that wanting to WORK from home - or "ho hum..I think I will just sit at home..." I was rated under 4.16©, in 1999 (even though the reg had changed), because the reg had changed, during my appeal, and by VA rules the rule that was most favorable, to the veteran, must be used. pr Phillip, I would appreciate if you would post the change. I wouldn't begin to know how to write any letter of disagreement to the decision. I am dumber than dumb and can't understand the rating in the Non Service Pension being for Anxiety ( so they say). I have not seen it in writing. Time says the pension is a moot subject. I will accept this. I just do not understand how with the nonservice pension, how the VA gave me the 50% for chronic anxiety when they did not have to pay me and when I service connected the chronic anxiety to service, for the same time period with the same medical records the rating went to 10%. I will chalk this up to my ignorance. As far as the TDIU. Did I fill out a form, I don't know any more, too many years have passed. Even back to 1992 is a long time for my memory. I understood the non service connected pension to state I last worked in 1983 due to the following illnesses. chronic anxiety with depression 1964 - date. continues medication, never controlled. Guess not, for I did not have Diabetes until 2002, Isk Attack 2002; disc disease 1990; hypothyroidism 1987; hypertension 1979. Am I to think that I could ever service connect these illnesses - Absolutely no! Even if they were mentioned in my service records. 250 Mg. Glupahage daily for diabetes - A1C - 5.5 Synthoid 37.5 daily disk disease a Motrin when I need it. hypertension - 120/60 I don't expect the VA to pay me for non service connected illnesses. Neither Betty nor any doctor documented the reason she has not worked since 1983 prior to the NSC exam. Thus, the record is silent as to any occupational impairment prior to the NSC exam. The VA does not recognize non combat veterans subjective historic accounts of events that are not supported by medical evaluations. Thus, they can not back date evidence. As far as I know the medical evidence she has prior to the NSC exam is prescriptions for meds and complaints of anxiety. There were no hopitilizations nor any significant testing nor GAF scores assigned prior to the NSC exam. The meds and complaints of anxiety will not result in a high GAF based on a review of the records known to exist. If Betty could produce a medical consult written in 1983 that her anxiety prohibited her from working starting in 1983 then she would have a basis for a higher rating to 1983. if the rest of the CUE stood up.
