Open Claim On Inital Visit To Vamc After Discharge

I was reading this reg and it made me think of something I heard early on:

§4.129 Mental disorders due to traumatic stress.

When a mental disorder that develops in service as a result of a highly stressful event is severe enough to bring about the veteran’s release from active military service, the rating agency shall assign an evaluation of not less than 50 percent and schedule an examination within the six month period following the veteran’s discharge to determine whether a change in evaluation is warranted. (Authority: 38 U.S.C. 1155)

I was thinking back to my initial visit after discharge back in 1994 to the VAMC. When I went there to get information in order to file my VA claim, I was told by the clerk that I already had an 'open claim'. ;) I was given a discharge due to a PD so I know that I wasnt rated but Im curious to know what that could have meant.

Does anyone know what he may have meant by that? Which government agency could I write to find out if I actually had an 'open claim' before I actually started the paperwork or what should I look for in my records (a code? Terminilogy,etc) that would show this?

Any help is greatly appreciated.

It is good that the doc stated they had read your SMR's -

there maybe something in the SMR's that relate to depression

and/or a reason for the depression.

Carlie, yes maam there is plenty of info in the SMR's. Actually as far as I can tell the only thing really holding me back was the nexus if Im reading all the past denials correctly. The BVA actually approved the claim being reopened based partially upon the nexus letter.

I to have a open claim,for I was not rated,for my hospital stay,the doctor stated If we can,t clear up the Infection,you will get a medical discharge, ...never got a medical discharge,I got a honorable discharge. however looking over medical papers,I saw qriginal disibilty code 13,when I googled,code 13, Ifound I did get a penison,under 38 501,I do have a legal cue claim,going to washington,friday,the cue Is already there,my lawyer,Is fileing form 21-22 A,motion

Wow ;) isnt that something? Ya just never know what all these codes mean.

That is why I am looking through my paperwork in detail now because I think I missed something. Thanks DAV
