Just to chip in my two cents worth, I'm afraid Carlie is right. I know that you don't want to hear it but you probably won't win this battle. No matter what happened on your exit exam the VA has what they need to deny the claim now. You may be better off looking at other issues and not stressing yourself so about this one. I have a bum knee caused by Uncle Sam but I was combat arms in Army and thought you just sucked it up. I have appeal in but probably won't win. It's mentioned on a physical but no treatment records. The point is we all have issues we feel should be redressed that we just don't have the paper trail to prove. Focus on the issues that you can change and don't cause yourself a stroke over the things you can't. Carlie was offering her advise based on her experience and this forum. Her emphasis may have been loud but it was on target. We get try to give factual advise here not just what you want to hear.

I know nothing about hearing tests, but I do know Carlie. I do believe all she was trying to do is help a veteran...as she had done hundreds of times.

One of her personal characteristics, which I admire, is that she is straight-forward and doesn't beat around the bush. If her experience tells her that a claim might have holes in it, she will say just that.

I'm glad that she doesn't lead vets on with regard to their claims.

With that said, I hope Stillhere receives all the benefits he is entitled to.

Still,

My hearing tests also showed improvement, I do not think I have hearing loss. I am not debating what your audiologist is saying. But I could easily see VA pull a doctor out of thier hat and say the annomoly could have been caused by different ear wax levels...level of attentivness.....Ect.

You got out in 71, have they taken a work history from you? They may try to evaluate what you have done from 71 to present and if you have any risky environments (factory work, ect) they may have thier expert state that is the cause of your hearing loss.

Your audiologist's opinion would be stronger if they specifiaclly stated why the seperation exam was flawed, other than no one improves. The VA's counter argument would be the entrance exam is flawed.

I would get a second audiologist on board with a statement because thier doc is gonna cancel out your 1st doc, you need a second opinion that refers to all of the evidence of record and hopefully states why the seperation exam is wrong (beyond improvement).

My 2 cents.

Tyler

Thank you tyler I am working on that right now. Actually I have requested a dro review hearing and hope to be able to show how I truly feel about this. I am working on trying to get the doubt that is supposed to go to the veteran to come into play. I have an appointment with my VA audiologist next month and plan to point all this out to her and ask for an opinion.

I know I could and maybe should just let this drop, it is not helping my heart any. But I feel us Vietnam vets have been shit on so many tiimes in the past me included because we just said the hell with it. I will not do it this time I will stay on this until the last appeal!

Good luck all with all your claims, may you get all you are supposed to!!

Still,

Fellow VN vet here. So sorry, this chain is quite long now. Are you also planning to claim Tinnitus? You are well qualified, and I can share with you how I did it. Very simple...Let me know.

Carlie was merely trying to help. I got in a beef in other forums, and have even been kicked out of one of em. Some of the posters are retired or current rating specialists and offer good advice, even tho some of em tell you what you definately dont want to hear.

Even tho nobody wants to be told stuff they dont want to hear, I would definately rather hear negative stuff from one of these posters rather than on a denial decision!

I MUCH prefer someone telling me that they hate me and mean it, rather than someone tell me they love me and its a lie. I got a chance of fixing what it is my enemy is mad about, but I probably will never be able to fully trust the "so called friend" who claimed to love me, when they they dont.

Carlie is calling it like she sees it, and I respect her for that.

That being said, I suggest to anyone they hang in there for any VA bennies they feel entitled to and NEVER give up.

The VFW once sent me a letter and "dropped" representing me because they did not think my claim was valid. I am really glad I did not listen to them..I knew more about my situation than the VFW did, persisted, and at least won partial benefits. I was mad at VFW for a while, but now realize they had too many Vets making claims so to do justice to the others, they had to drop some Veterans as they were just too busy to take care of us all. I think they may have dropped every fourth claim or something like that.

Keep on keeping on..persistance often wins over skill, talent, and luck.
