Back Pay

Question

I have a ? about Back pay on a claim, I filed a clam on September of 2007 IBS and Hemorrhoids secondary to my back, I am not getting payed for the date on the clam but for the date sent the new information from my doctor, just wondering if this is the right way it should be done? I also have a big problem with the VA in little rock, my local va office and I called and ask, if the pay date was right on the claim, we looked at some of the date on my clams and they are not the same as the ones they gave me on the decision on my clam.I am going to the VA office in little Rock to find out what is going on, they lost my file when i pissed on one of them on the phone, i called a month later and all my claims had been closed. I went to Little Rock and talked with them and they got opened again, but dates are all messed up which messed up the date, unless it was done on purpose, I hope not.

I understand it now. The decision was actually correct but there was an error in the math.

It would have served you better to not have written a NOD and wtitten a letter with a detailed explanation with copies of the award date and copies of your bank statements for the months they missed.

I had a math error in a award letter-and also the VA started sending me DIC but for the wrong yearly rate.

The award letter (a old CUE claim I had that VA and BVA had denied but the Regional COunsel awarded me)looked very official in it's breakdown of the math.

I sent the VARO a letter with my C file number on it, a copy of the award letter and a copy of the last DIC check I got.

I said I wasn't great in math but I think they owed me about 300 in DIC underpaymentsthat they ,had to begin the new rate of DIC for future payments and that I thought they also owed me

about 11,000 bucks due to the RC award and I enclosed my calculations as to their breakdown audit sheet.

Within 3 weeks they sent me the DIC they owed,fixed the rate thing for future DIC checks, and they sent the 11,000 bucks.

Letters regarding mathematical errors appear to go right to their finance department for corrections.

PS- all that taught me two good lessons-

NEVER accept a denial if you feel you have a valid CUE claim.

And Never accept a VA retro award until you have gone to the historic rate charts at the VA web site, and have figured it out for yourself.

I went to little Rock today and talked with my rep, we are requesting audit on my file and the dates, we will see what happens. Thanks for all the help, and I know what you are saying Berta, I have fought with them for 4 years over my clams up to 70% now, I have 2 clams at the rater now, waiting to see what happens with them. I will keep you informed.
