Vmac Refused To Release My C&p Exam Requirements From My Exam Coming Next Month

Greetings,

It appears I am in a battle now. After granting my request to fax me a copy of a C&p exam this afternoon. I have been denied that request. I wanted a copy of it to take it to my private doctor to have the same exam done. I even faxed a request under FOIA. Can anyone give advice or regulation that permits me to have access to this exam requirements? God bless.

Dear Sir.

I have had that problem about 4 differnt times.

What I did is immeaditly file a writ of mandamus to the court of veterans claims. Within a few days the VA gave me my C&P orders.

the VA pt bill of rights says we have a right to know of what we are participating in medically in the VA hospital. You cannot give proper concent if the VA keeps seccret what it is they are examining you for.

The Director of the Orlando VA ordered the clerk at our C&P office to start giving out to the vet C&P orders when asked for them. Ecen when ordered to do so the clerk still refused vets on her own.

Its been ruled on by the courts and found the VA makes allot of errors when ordering C&P. This can delay a case for years or rig it to loose all together. IF the vet knows prior to the exam itself that there is an error. He can correct it and get the exam for the right issue. Knowlege is power and the VA hates giving any vet an even playing ground.

I found a writ caused the VA not wanting to have the court rule on that issue.

Thank you for your response. It's good to hear from you. You and Berta have helped me a great deal.

As an update in this issue. I contacted the VAMC Medical Director at his office after this person denied me my exam after I had faxed her my FOIA. I knew I was once again being decieved by the VAMC I though they would have learned their lesson when we all had a meeting before the VAMC Medical Director (I audio taped the entire meeting. Berta's idea. It was great. I had the Director scurming in his seat)

I was told my the VAMC Medical Director receptionist that he had steped out for a few monments. I informed her of this issues and I was not hanging up until I spoke with the medical Director. She was not thrillled with this answer. I stayed on hold yesterday afternoon for 1 hour until the Director came on, and gave me an apology, and would you believe I received by fax the C&P exam ordered by the RO because of the 1151 and Federal Tort claims. Dr. Bash's opinons with my other outside the VA doctors has the vA in reverse. They know my cliams are legitement and they acknowledge their were errors upon their part, however at this point we do not know how much responsibility they are going to take.

I am not going to let them off the hook. I am tired of the whole process as I see vets being conned by the RO and many lazy service officers. If I remember right the name of this dog and pony show is "The Deapartment Of Veterans Affairs". Thanks again Terry. God bless you.

Another vet site says the Court has never granted a single writ. I found that hard to believe, so I am glad to you hear you got one. Thanks for giving me the good part of the story, or at least one good part of it. Too many vet sites are out there inciting fear and discouragement--more reason to appreciate hadit and veterans like you. :P

Yessss .. Terry is one brave and tough soul and has no fear of the VA system either.

For those of you that don't remember ... When Terry was getting pounded with the various hurricanes in FL ... He tied himself to a tree and fought off the storms with his .."Gas Powered Leaf Blower" ... now that take some guts .. lol ... :P

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
