Comp And Pen Exam

I guess all the Iris InQuiries I have done on My shoulder Percentages has made the VARO schedual Me for a new exam..for my shoulders it only took 9 months ...I hope the same CnP examiner is not there .. HE WAS LIKE 90 WHEN HE DID THE FIRST ONE. any idea if he is still there, Berta? Also when they sent me for the re exam at the Buffalo VAMC .. :) They were the ones who ripped my left shoulder at that exam... I just had that repaired in january... have not worked sence that CnP exam .... What now..

Waited ...Yes I have and I , think ..This examiner is going to be fair. He didn't give me the Enemy feeling when I was being examined.. he seemed sincere . and concerned.

Berta, how is Life after the win you received? stress came down some I bet. I am still smiling over your good News.. B)

Rick-I bet others here can relate to this-

I still get up every AM ready to continue to fight my claim.

And it is over-

well sort of- they screwed up the award letter big time but they are supposed to be fixing it per the new VSMC at Buffalo.

Not only did I get the award decision but I got letters from Congressman Filner and also the CHairman of the BVA- all saying I succeeded in proving Rod's death was due to AO.

Yet it is still hard to believe.

The BVA decision covered all other claims I had too.

If I didnt know any better and had never heard of the Nehmer Class action lawsuit -I would not know how messed up the award letter was and that they forgot they owe me money.

I had to prepare my own award letter with citations and send it to them. All they need to do is put it all on VA letterhead and send the file to Finance. B)

Thats great........... Do you get to pick how much retro you get also.. I bet they don't need help with that.. I Think they pay people to do the job you did ..and We all have had to do , So why again are they payed? I bet you could replace 10 of there workers ... LOL

Hi, Everyone.!

I have received Copies of My CnP exam Today.

I have finnally been examined by a examinier that wrote everything down and was fair..

Its states in the CnP exam ,that I, where slings and emmobilizers .That both shoulders lock on me .

That my "right Shoulder dislocates and that I can't do My job because of these injuries..also that The Meds I take..Make me hard to get along with. and I take things so I can sleep.while in pain... Left side is moderate and Right side is severe..even says the My right is deformed from the surgeries. "It is "I look funny in tank tops...right side droops terrible.. lists all scars size and location also..5 on left and two on right..with the final notes saying that the right side needs another sugery ..

the examinier also stated that I get back and neck problems because of the injuries?

maybe later ..now they can be connected to service? I, think later I will need that .I have ended up at the emergency room numerous times because of this.

evidence of pain with active motion on left side. - Yes

Left flexion 0-114 degrees

left abduction 0- 101 ""

left internal rotation 0-55 ""

left external rotation 0- 40 ""

evidence of pain with active motionon right side. -Yes

Right flexion 0-93 degrees

Right abduction 0-74 ""

Right internal 0-24 ""

Right external 0-11 ""

Unable to perform job any longer .. problems with daily activities-- yes - yes

I am hopefull now finally after all these years that I will end up with a fair rating..they even stated for the first time that I was injured while on active duty in SWA in 1991..wow only took 15 years..

any of the members want to guess on my % s .. lets take a pole and see if we are close..

I am sure it will take awhile to complete..

Thats my guess also.. so far -- 2 - 50%

Can I get IU at 50% ?

      Frost v. Shulkin (2017)

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
