Question

Would you be better of when filing a claim put down asbestosis or lung disease?

Seems like the VA plays the name game to their advantage when they can...........

Here is what I put down for My Asbestos claim. Request compensation for a Lung disorder, ( Restrictive) with a FVC of 56 and Diffusion of 40 with rounded atalectasis with commet tail, Lower lobe scarring due to a direct result asbestos exposure during Naval Service as an asbestos worker.

They are still kicking it around and have admitted the fact of asbestos exposure in service.

Ask for the lung disease resulting from asbestos exposure.

FLHRCI,

When you find that SO I bet he will file on more general terms. If you read BVA cases you will find some all inclusive types of claims.

In the mean time my suggestion is the following. " Any disease, injury or condition that is related to the symptoms noted in treatment notes. Such diseases, injuries and conditions including but not limited to Asbestosis and restrictive airway disease". Provide them with any medical records. You do not have to weight for them to get your file. Go to the hospital and get records you think are relevant and submit them to the RO. Also give them records from your SMR.Always provide them with the name of any hospital where you were treated. They will probably send you a form requesting such information about treating hospitals and physicians.

On my first statement of the case it was obvious that they do not read records with such expertise to know what they are reading. That is why you need to get medical doctors to go over the records. Such as during C&P exams or if you can get a doctor to write a nexus letter for you. VA hospital are required to write bexus letters. There is a form you can take them explaining the law. Remember I won my claim without ever having a C&P exam. I got a nexus letter that was a slam dunk. I went to the hospital with my records and the letter circumvented the C&P process.

When I had my AO exam the doctors took an x-ray of my lungs and said I had some pleural thickening. What does that mean?

Diffused Plural Thickening

This is similar to pleural plaques but it affects more of the pleura. The membrane in the chest wall becomes thicker. This process can impair the function of the lungs.

The symptoms are breathlessness and/or chest tightness and/or pain. This condition is usually caused by heavy exposure to asbestos

Have you had a cat scan of the chest?

It would be a good idea to follow up on this.

Maybe I will look into this. Since it was a VA x-ray I am suspicious of the diagnosis. I would get confirmation from civilian doctor.

they told mw that in 91 and 97, then they told me it may be just "FAT" :)

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
