Does anyone really know what happend when the VARO recieves the VA 9 on your appeal? Do they re-look it to see if they really did such a poor job during the DRO process or do they simply throw it aside for a few months then do what is called certification for BVA and then ship it out? I was told by a vet locally that they normally reviewed it again to see if your new arguements was going to make them look stupid and if so they would probably re-rate it and issue a SSOC. Anyone out there want to take a guess? Surely since they keep it around for a few months they could take another 15 seconds to look it over.

Generally, I'd say they wait and then certify it. They "don't care" if they look stupid. I certainly doubt any review other than issuing an SSOC. As far as they're concerned they've completed the claim and they won't have to deal with it for about another two years, if at all. jmho

My appeal (the VA accepted my SSOC response as my formal appeal and I have letter stating that)

filed on Jan 4th, 2006-went to

1/24-Appeals Team,1/23 Directors office,1/25 IG response,1/26 rating specialist, 1/27 Authorization, 1/30 Authorization, 1/31, Authorization and with senior VSR, 2/1 appeals team chief/2/3 appeals team/2/6 appeals team/ adjudication/ 2/14 DRO to Coach/2/9 IG rresponse/2/9 clerical satff/,2/9 claim established.3/3 authorization, needs signature, decision made,3/8 predetermination team, 3/1 letter to me to see if I have remarried, received Mar 8th,3/12 CUE claim letter/ and also as of January 31st -930 pending-which could mean End Product pending.

(I filed a formal I-9 too but they gave the Response to SSOC a lot of attention-basically the same statements)

The VARO has made so many errors so far -which I laid out in my appeal and response to SSOC that I call twice a week for updates-

good thing I do-something awful happened in Nov which then became a Miracle- long story there---

If you have laid put your argument-getting their attention on page one of the I=9 and stating what NVLSP suggested (which I posted here some weeks ago under an appeals topic-)

obviously the will give it some attention before they docket it for the BVA.

I have more evidence to send them-if needed- waiting for something on their PC screen to change-

and will continue to draw them out with SSOCs until they give up.

I have made that quite clear to them in my appeal.I played their game before.

Everytime a vet can get them to prepare an SSOC, there is chance they will say something that can actually help the claim.It also means that they again have to READ the claim and the evidence to write the SSOC.

In my last claims-I was docketed at the BVA (1996?) however continued my argument with them at the VARO level and sent more evidence.

After getting 3-4 SSOCS, they awarded both claims.

They will review your I-9 carefully- but I do suggest doing what NVLSP said on the appeals form-

forget where that prior post is-

I take much of the 800# stuff above with a grain of salt-(the authorizors could have been folding it all up into paper airplanes) however I know there has been movement since I filed my response(appeal)

I ask for the VACOLS screen and the COVERS screen when I call 800 and ask for any four digit codes-like the 930 which has 5 different possible meanings.

These codes are all available in M21-1.

I would try and get a personal hearing before your claim goes to the BVA. Get another shot before it goes for the two year hike, and a remand.

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1.       Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
