Could someone put up a link to 38 USC 1154? This law is one which V.A. seems to disregard often. In section ( b ) of 38 USC 1154, V.A. is supposed to service connect conditions for veterans who have engaged in combat with the enemy. I believe that V.A. considered this law when V.A. granted my father service connection for a hearing loss from WWII. Dad's records had burned in the fire at the National Personnel Records Center but he submitted a copy of his DD214 Army discharge showing he had been stationed in Italy, Belgium, and North Africa during WWII and had 2 bronze stars. My dad also submitted a statement explaining that he served in the tank corps in North Africa and that his service-connected hearing loss was so severe that he was offered hearing aids when he was discharged from the Army. THE LESSON HERE FOLKS IS THAT IF YOU KNOW A VETERAN WHOSE RECORDS BURNED IN THE FIRE AT THE NATIONAL PERSONNEL RECORDS CENTER IN 1972, AND THAT VETERAN STILL HAVE HIS DD214 MILITARY DISCHARGE SHOWING COMBAT THAT VETERAN SHOULD TALK TO A SERVICE OFFICER ABOUT 38 USC 1154 AND WHETHER HE SHOULD FILE A NEW CLAIM FOR SERVICE CONNECTION OR SHOULD TRY TO REOPEN HIS PRIOR DENIED CLAIM FOR SERVICE CONNECTION BASED ON NEW AND MATERIAL EVIDENCE INCLUDING A COPY OF HIS DISCHARGE AND A SIGNED STATEMENT FROM THE VETERAN ABOUT HIS EXPERIENCE WITH COMBAT AND HOW HIS DISABIITY WAS INCURRED OR AGGRAVATED BY MILITARY SERVICE.

Determinations as to Whether a Veteran “Engaged in Combat With

the Enemy” for Purposes of 38 U.S.C. § 1154(:D

Is this the latest regulation that the DVA is supposed to follow? I have a copy dated October 18, 1999. I have searched high and low and can't find a newer revision.

This isn't a regulation, it's a law. Simply search online for United States Code. Then tap the link and search under 38 USC 1154.

38 USC 1154 is a law in the United States Code.

It still kicks back however for proof that the veteran engagaed in combat with the enemy or was within

the criteria to witness or had reason to fear eminent possible hostile or terrorist activity.

I have no status on this proposed reg and the Federeal Register site is down for maintenance.

Many combats awards have failed to make it onto DD 214s.

If the vet sends application for correction (DD 149 form) to specific address on back of the form,this could produce a DD 215 containing more awards.

Often a vet's only way to prove they engaged with the enemy directly would be by obtaining buddy statements.

Most Units have web sites and can be one source of finding a buddy. Sometimes just by googling their name something could crop up.

I never mentioned here before this possible way to find buddy-

I use occasionally Intelius and also two on- line detective web sites-for personal reasons-both have fees for these searches-however the fees are not exorbitant and one could possibly find a buddy this way too.

I never gave thought over the years here at hadit when I used these sites for another reason-that this too is one more way to possibly find a buddy.

A Buddy statement has to contain certain specifics.I posted topic here on what they need to contain.

Sameo to us -They (VA) have 38 CFR ,38 USC, and M21-1- but so do we.

      Service Connection

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
