Sent My Appeal To Wash Dc

B) Update

My appeal for an EED for the 30% on my rt shoulder was sent to Wash DC end of 2009.

Going for another surgery on the right shoulder Jan 28th .one year after the left shoulder being done.

I did not get the IU I was denied . no big surprise thats why I got 50% vs 60%.

I can-not work though because of my SC injuries .. In for more fighting.. No surprise..

So I sit unable to do much .. surgery the 28th maybe it will work and I can go back to work.

Is the TDIU claim still at Buffalo Rick?

And the shoulder claim at the BVA?

Reason I ask is if you could have challenged their TDIU decision at the regional level unless it all went on the I-9.

Have you applied for SSA disability since you arent working?

PS- dont know if you heard that I won my AO death claim at the BVA.

The BVA finally read 6 years of medical evidence that the RO never even acknowledged.The same RO you deal with too.

Buffalo messed up my award letter so much I had to take extraordinary steps in November to get it fixed-

I have letter from the OGC that says they contacted VARO Buffalo (which I got verified by VACO too)and a new and proper award is being made.

In discussing my problem with the OGC I told them of the consistent problems that Buffalo has been making in claims and even NVLSP lawyer told me he heard many complaints on this VARO.

I think many of your claims problems were caused by the VARO itself.

The BVA can read! As long as they have all the evidence (and you can send them more at any time prior to their decision) they will make a proper award determination on your claim.I think it took about 8 months after transfer of my claim to the BVA for them to award it.An additional VA opinion they ordered only took a few weeks.I knocked the copy of this opinion down as soon as I got a copy and sent my statement to the BVA. The BVA gave it no weight at all because it contained speculation among other things. It is hard to know how far on the docket your case is.

Hi, The Buffalo VARO denied MY I.U.and sent My EED to DC.I have not officially on paper appealed the I.U decision yet. The statement of the I.U. Case said that at 50% and no single SC disabuility at 40% or higher the I.U . is denied. can't argue that..its in the regs. So i sit pondering my next move if any.. "maybe" Re try my hearing disability..Or just go for the Depression that the hole mess causes.

I am at a stand still.. Lost in a see of VA crap..

Yes..that is too bad..did you ask for a DRO? If you didnt maybe its not too late, since VCS, on 60 minutes last night, said there is a 200,000 claim backlog at the BVA and it takes 4 years..maybe longer when you are just starting now.

My BVA/RO claim took 7 years, and my home and truck were both repossessed during that wait. I asked for an "advance on the docket" due to my pending foreclosure, and the RO has "no record" of my request for advance on the docket.

I would like to see Wolford wait 7 years on his paycheck...and tell him..gee, we are working on it as fast as we can..unfortunately, our shredders are broken now, and we dont have the budget to shred your evidence..so we have to hide it in drawers until after you die. ..we are just so overwhelmed processing VA bonuses...there are 1,000,000 ahead of yours, and you just may get your house back someday. Please be patient....we will "process" your check as soon as we can, in the mean time you can share a spot under a bridge with some Veterans you made homeless a few years ago.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
