I would like to run this by all as things are at a mess at va first my husband was in the air force 46-49 he was in the hospital 5 months in japan in52-56 he was in navy on uss wasp the night it sunk the hobson. in 1978 he put in a claim for hospital stay in 48 va stated no records found in 2000 we got his files all his records were there in 1994 found in records a so stated to re-open sc for ear and raidation va never informed him of this action i haved filed duty to assis on the fact no records found i also filer duty to assis for cue or 1993 in 1994 we filed for a penison we were denied but va did state from your records of 1948 so va had them in 1978 any way this is ehere we are now he got 100% for ptsd now we have medical records to prove unemployable ssd 1993 va dinied his claim they even deny his shoulder stated on ro in 1993 to re-oprn claim sc for ear the ptsd and shoulder are from navy we have a helpless child over 18 we would like to add him on as a dependent i have a letter granting my husband 100% for air force and navy have fax fron va to champ stating with hole effected date supend 30 days expires in 30 in 30 days i state all service time must be back to 1948 and 1952 at 100%- my son added on a time of birth also i might add in 1994 va gave he 100% for non service connection i have responed with duty to assis benifit and cue pppplus they wanted medical records of my son i gave them all doctors names tu contact va never wrote to any doctors will state thst. mind you all this came from va records va claimed did not have in 1978 now we are at ssoc we have duty to assis benifit of doubt cue i would like help from members you might know something i don.t i think my husband should get 100% for each service + back money due him our son added on to his birth myself added on at marriage va had this information kert back 58 years they always had the records that;s how we found out thank you Elizabeth

I have replied to you three times on this matter-twice on April 29th and also in my IM section-

I posted the Helpless child regs here in April and they can be found through a search-

A CUE claim is the only way to potentially recover an earlier effective date-

As I stated before a CUE claim- which you state you filed -does not depend on Duty to Assist or Benefit of the doubt regulations.

A CUE is only filed on a final decision- never appealed and must clearly state what regulations (in existence at time of alledged CUE) were broken.

The BVA at http://www.va.gov/vbs/bva/

has CUE claims that you should read carefully to see how the vet succeeded or why they didn't.

If the SSA award your husband got in 1993 was not considered in the pension denial in 1994-

that possibly could help the CUE claim.

also this reg might also help: 38 CFR 4.2

"In considering the severity of a disability it is essential

to trace the medical history of the veteran. 38 C.F.R.

§§ 4.1, 4.2, 4.41 (2005). Consideration of the whole

recorded history is necessary so that a rating may accurately

reflect the elements of disability present. 38 C.F.R. § 4.2;

Peyton v. Derwinski, 1 Vet. App. 282 (1991)."

This is a CUE claim which was denied but contains much BVA rationale to show why it was denied.

I am thinking that the Pension was denied by VA in 1993-or 1994 due to the fact that your husband got SSA award which might have knocked out the amount of the pension.

If the reason for that denial however, was due to not finding service connection,yet the VA had SSA records that showed SC disability caused unemployment-that decision could be CUed using the reg above .

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:
