Vet Put In For Claim 06, 07, 08, 09, And 2010

Question

Vet req all records and requested claim to be activated in 2006. Received a CD but No written file received.

Vet sent another letter 2007, waited...nothing but a CD copy with little info. Sent application for C&P and requested records again. Sent req.via IRIS too. Waited.

Contacted a VSO to put in for informal claim as did not realize he didn't need to do this as prev sent all info for formal claim. Got letter that no such copies exist from VARO and no such records exist anywhere.

2008, contacted VSO still requesting records...nothing but CD received.

2009 vet requests VSO to check on claim status and requests all c-file...finally receives paper copies of most records, but not surgical records while had surgery in Balboa military hospital, and noted copies of letters, email(iris) letters from 2 different years in folder of records from vet, but no copies of filled claim prev sent.

Called call center end of dec 09 to find out what is going on with claim, VA says no claim ever filed, and vet is not in system...sent all copies, including the ones in folder of vets requests and stating file for disability certified/registered. Waited. Finally March 2010 vet calls call center, and they say no vet in system, no claim received. They say they will put in for new claim, and will have someone req copies vet has and copy of cert/reg receipt.

Come on people talk about stalling.

So should he go through his poa vso? He also has copies of emails from 07 with vso telling him claim was put in to VARO.

What is the best/fastest way for him to proceed? He is GW vet, and has many physical and psychological problems too. Yes has combat ribbon too amongst many ribbons and medals awarded to him.

I think they must have shredded his stuff as the responses or lack of responses he gets. What do you think?? :)

To get on this VSO's butt.( and contact his supervisor too) best to do it by email or snail mail.(For hard copy)

I assume he formally sent in a 21-526 form?

The VSO would have a file on him and copy of the claim he filed.

Also that file will contain a copy of the VCAA letter and any other correspondence that VA had sent to the vet as well.

It would be terrible if the rep failed to send the claim to the VARO as he said he did.

The rep would have some proof if he did.

Still- what happened in the time frame from when the vet thought the claim had been filed?

Did he receive anything at all from the VA?

Did he move and could that be the problem that VA had no contact info on him?

If his claim succeeds, he has lost comp already.

If the rep caused him that loss- the rep can be sued.

I recommend submitting a "new claim" referencing the one already sent..even a new 21-526. They will probably eventually act on the new claim, and then you will have to file for an EED.

Bottom line: The VA shredded the Veterans claim, and you will have to fight tooth and nail to get what is deserved. It will probably take a decade before it is finally resolved.

If the rep caused him that loss- the rep can be sued. HE HAS LIKE 6 or 7 EMAILS FROM VSO ASSISTANT. IN FACT VSO STATES HE DOESN'T SAVE EMAILS, BUT VET DID.

Hello All Hope All Is Well.

As long as there is a paper record and reciepts of correspondence to the VARO and VSO make copies of all send to House Sub Committee of VA Investigations to start also General Counsel stating the fact that claims were sent in and NO REPLY NO RESPONCE.

Or obtain an attorney.

I have learned in a short period of time you have to do all the leg work and homework for these laszy individuals in order to get resolve and sometimes this does not work .Next suggestion is FEDERAL TORT CLAIM.

I have a similiar claim filed in 1992 it took until 1998 for another VARO and BVA to deny the claim but it will be addressed in the near future to include the VSO lazy ass bastards at the GEORGIA STATE DEPARTMENT OF VETERANS AFFAIRS.

I think Bronco has the right track. The first thing is to get service connected and than prove up why effective date should go back to original filing.

Halos, sad but true. From what I understand sometimes different regional offices send their cases to other regional offices, for review. So the office he sent his claims to might have sent it to another office. IT SHOULD BE THE ORIGINAL OFFICE RESPONSIBILITY TO KEEP TRACK OF EACH CLAIM. I wish we knew the First regional office. It is time we start pointing out the offices where problems exist...
