Thank you for having this forum

i have tried and failed since 1984 to get disability for diagnosed by a NAVY hospital for pulmonary artery insuffiency,they try to say it was there EPTE when i entererd the NAVY hog wash i have given up after 3 denials every time

I live at least 100 or more miles from any VA hospital

I was also diagnosed at the same time with anxiety reaction / DNEPTE / unstable personality / emotionally unstable personality

II spent over a month over a month in the heart ward of the PORTSMOUTH VIRGINIA NAVAL HOSPITAL..

diagnosed with depression and anxiety 3 times one at DUKE UNIVERSITY

2 times I HAD bad black malari ,spent 1 week/ and three months later over 2 weeks in the hospital at LITTLE CREEK VA

at least one documented suicide attempt

been on SSDI since 1998

totally unemployable

letters from PASTOR / CONGRESS / WIFE / DAUGHTER / and SPECIAL OPS 82nd AIRBORN / VIET NAM friend

i was only 18 at the time 1966

I have finally got a letter from the VA they are getting me a psyc appointment

now here is what i want to know.

what are my chances of getting disability this time anyone, or am i dreaming

If your problems were NOT NOTED on your entrance exam physicals, then IT DID NOT EXIST PRIOR TO ENLISTMENT (EPTE). PERIOD. Now, if they, for some strange reason, have PROOF that you had prior problems, then that is something else. BUT, if you just, for example, told them at the enlistment station that you had heart problems when you were, for example, 13 years old, THEN THEY STILL CANNOT PROVE THAT YOU HAD HEART PROBLEMS, even if you TOLD them that you did. Why? Because, for the same reason that they will NOT accept your opinion concerning your current disability (hence, the requirement for a Compensation & Pension (C&P) exam by a medical professional) then the tables are turned and they cannot accept your telling them about your medical condition when you were 13, or anytime BEFORE your enlistment. Period.

SO, they HAVE to prove that your condition existed prior to enlistment, beyond reasonable doubt (and, remember, when there is doubt, the decision goes to the veteran's favor). DO NOT LET THEM GET AWAY WITH THIS.................I feel very strongly about this, simply because they tried that EPTE bullshit on ME. Fortunately, I had the profound privelege to know an excellent veterans' advocate who was an active member here until his recent passing.
