Is The Majority Of The Wait Over When A Claim Goes To The Rating Board?

Rate this question

Question

I found that my claims have finally moved on to rating. I understand some claims drag on and others can be decided quickly. Is the majority of the wait over when a claim goes to the rating board? OR, are there many months more of waiting to be had?

Thoughts?

(I AM NOT A RATER- I work the claims BEFORE they are rated, annotating medical evidence in your records, VA and Legal documents,  and DA/DD forms- basically a paralegal/vso/etc except that I also evaluate your records based on Caluza and try to justify and schedule the exams that you go to based on whether or not your records have enough in them to warrant those)

In my opinion you have overcome some major hurdles and if you have current favorable exams it may be soon. Can't be much more specific than that we are dealing with the government you know.

I dont exactly know why but the AMC seems to take a lot longer than they need to to rate claims. I know some folks who have been at t he AMC for 7 or 8 years. These folks have some very complex claims.

Can you ask them what is foing on?

J

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

X186hd,

Just to ensure you're not disappointed I will point out that the VBA has no timeframe

to adjudicate your claim.

Plan on waiting for at least 2-18 months longer.

You may not want to hear this but....... Just because VA says it is ready for rating doesn't mean it is.

I was bounced from ready to rate back to development twice, they have finally made a favorable decision on one item and deffered 6 others (in essence they are going back to development for exams ect.).

The VA will eventually make a decision - The Yellowstone super volcano will errrupt again at some point in the future. The question is which will happen first?

For the time being, reorganize and review your evidence, if they conducted C&P exams get copies of them (if you havent already). Know where everything is so when you do get your decision you can check off what they listed as evidence, against what you know they were sent for evidence. When the decision comes read it......celebrate or get angry. Don't write your NOD or reconsideration request until you have simmered down. I have re-read my decisions 2-3 days latter after receiving them (cooled down) and find/understand details I missed the first time I read it.

Best regards,

Tyler

going to the rating board simply means the development team feels they have collected enough evidence so a rater can make a decision. At this point your claim goes to the bottom of the stack of the ones that is already on the desk of the rater it has been assigned to. He/she could already have 50 claims assigned or 500 claims assigned to them. Then when he/she finally gets to your claim they may feel that an exam is needed or some other piece of medical evidence at which point it goes back into the development team..... so on, so on, so on......... There is no way to really tell as it could be 1 month (if you just recently had an exam) or it could be 12 months. There is nothing you can do except insure your claim is as complete at possible when you submit it. Then just forget about it for a while and enjoy yourself with some reading, fishing or fussing with the SO. If you choose the latter of the activities always make sure you win or they may throw you out of the house hahahahhahaha!
