Federal Technician/ Air Guard Claim Help!

Question

I'm considered a dual status federal employee(air guard). I were the uniform just like active duty, exept I'm only activated when tdy or deployed. I'm wondering how a va claim would effect my active duty pay, and federal pay or would they even let me file a claim. Anyone have any experiance with this issue.

I assume you mean Air National Guard.

This BVA case gives an idea of where your STRS and SMRs might be kept if you dont have copies - and also defines a'veteran' for VA claims purposes.

You have every right to file a claim.

Somehow you have to establish a nexus due to something that occurred while you were on duty as this case shows that this Air NAtional Guard veteran also was a commercial pilot and the VA could easily attribute his back disability to that instead of his air guard duties.

This claim is on remand and the remand shows what the C & P exam must cover.They are many vets getting VA compensation while employed by the federal Gov.

What is your present guard status ?

I'm currently active duty medical contiuation. Waiting on a bone that is having a problem healing. Came back from a deployment got a line of duty paperwork, going on my second surgery. If bone heals I go back as a federal technician(Air Guard), if it don't, well that is why I on this website and the PEB forum. Just trying to be prepared for the worst.
