Ptsd Denial Over And Over

Rate this question

Aiden

Question

I filed for PTSD in 2006 and have been denied over and over even though I was diagnosed with severe PTSD by a VA psychiatrist. I submitted my evidence supporting my claim. I was told that Afghanistan wasnt a stressful environment. I dont understand what the deal is with the VA. There is a young man that lives close to me that was in the Coast Guard and he witnessed a drug bust on the Mississippi River and he recieved 100% for PTSD but Afghanistan is less stressful than that. Everywhere that I try and turn for assistance with my claim is a dead end. Any pointers or help would be appreciated. I currently have 50% for my back due to an airborne injury and my right knee. I cannot even put my shoes on by myself anymore but that it only good for 40% and 10% for a torn ACL in my right knee. The VA doctor told me that both knees had the tear but only one was paid for. I have made this statement before and I will say it again, I would rather be back in Afghanistan than to deal with the stress that the VA puts on me and my fellow veterans.

Aiden:

Welcome to Hadit and I know that you are frustrated. First of all don't worry what the VA has done for rating for other Veterans cause I guarantee you do not know all the circumstances.

Let concentrate on your claim. You have the hard part done a VA shrink has diagnosed your PTSD. Now you have to get it linked to your service and than it should be rated by VA as to how it affects your life today.

Since you have been denied have you already appealed the decision? Do you have a Service Officer and if so what do they say. Are you working? If you are not able to work you should apply for Social Security. If you are working cause the way the VA rolls they will low ball you on PTSD cause you are already at 50%.

As described I am flabergasted that you did bot get a rating for PTSD. Don't give up. If the claim is still at VARO ask for a Hearing and sit down informally with a VA rating officer and at least find out how they have detrermined that Afghanistan was not stressful enough.

Good Luck

Can you scan and post the Reasons and Basis part of the denial letter?

(Cover personal stuff like name and c file number.)

In our PTSD forum here is the VA's new criteria for PTSD.

Did you claim fall into this new regulation's criteria?

If you had any combat badges I don't know how the VA could deny you. That is not even required under new rules for PTSD. What was your MOS? Did your claim fail for lack of stressor verification? That would be old criteria.
