GOOD MORNING ALL,

i was going through my file and found some paper work from the VA.

i filed for an increased back in Feb. 2004. I was hospitalized in April 2004. The VA request for me to go to a C&P exam in April 2004. I contack them from my hospital bed and told them that I was in the hospital at the time and could not make it.

i did not get out of the hospital until a month later and then admitted again two days later. I was later released three days later. I could not do anything.

I received a letter of denial on Jul 2004.

i was off from work until November 2004.

If they had contact the doctors, that I had given them the address and name of they could have process the claim.

Is there anything that I can do not. I know my year or years have pass.

Just wondering.

You can re-open your claim issues that were denied

or lowballed in a prior Rating Decision, by submitting

a re-quest to re-open along with New and Material evidence.

Carlie passed away in November 2015 she is missed.

so, if I have been rated for that already, they will not give me an early effective date.

I suspect you would not get an EED, as you have a year from the date of denial on the SOC to file a NOD and it sounds like you missed that. I would follow Carlie's advice, if awarded you can always request an EED.
