Dro Hearing

I've got another DRO Hearing Wed AM and I am a freaking wreck.

They have these damned issues so discombobulated it's a freaking

mess.

Damn - I'll be reading something and realize it's an SSOC

say from 2008 and it will state something like some material difference

from the SSOC dated 2006.

I start looking thru the evidence and it will say something like,

additional evidence contained in the SOC dated 2005 and evidence submitted

with you NOD on XXX 2004, and all evidence contained in the

Rating Decision dated 2001.

It's a friggin bunch of BS we are put through - right now I am just so

fed up and filled with hate and rage at the freaking bas*@#ds that

don't take any pride in doing adjudication or working in the mail room,

the pre-determination team, or the C&P examiners.

If it weren't for the half azzed work that is done most of the damned

back log would not exist - but hey I guess that's job security.

I just recently had 2 issues SC by BVA - one goes back to 1999.

The VARO figured the effective dates for staged ratings but they

only went by the PFT findings. The decision listed in the evidence 8 different

PFT findings to support their staged ratings - but the bas&$@( that did this

negated to look over or list any of my Echos from 1999 forward, which support

a single 100% rating from 2000 - which would also provide me SMC S from 2000.

OH but hell no - they can't do the Fing job right so now even after all the BS,

I'll have to NOD the damned VARO's poor decision because they did not bother

to adjudicate all of the evidence.

SOB's - I just want to rip the sheet out of something - I am soooooooo glad

I don't drink booze any more or for sure - I would be a bad azz drunk right now.

Carlie passed away in November 2015 she is missed.

I know aout being a mess... I never in my worst dreams thought I would end up being one of those looking like a person so screwed up,,,,, and feeling 100x worse...

one of the c&p docs asked me how I felt and I told him I am a mess, ane said I can't write that down, I need specifics... with too many serious issues and having been though absolute hell fighting for like life in a hsopital bed for six months and having enuro physicls, and sphco issues,, I am the product of a meatgrinder

I always thought of myself of thinking logically,, but dealing witht he va there is no way to use logic,,, because they do not use logic, and they do not recognize logic...

absulote instanity is the only thing left after dealing with this cruel heartless organziation ..... who does not follow it's own rules, and it' own goal is to kick vets out the door without benefits.. that's their mandate, that's what they live for... on Friday they celebrate each vet that gets nothing...

if we were not sick when we went in, we came out insane..

Not in appeals, since I got 100%, and some of it was winning an 1151 negligence, which the VA turns out does not give ful benefits if you win 1151 negligence they squirm and legal loophhole you and your family out of many benefits, really crapp nasty bunch running the va benefits, they wil backstab and scre wyou even if you win you lose. May 2021.

Carlie, you need a margarita. Now I am not going to tell you not to get too worked up about this crap as it will do no good. What I can tell you is that a lot of folks here have sincere faith in you and we know your abilities. You are one heads up individual and your research and evidence is impeccable. The Echos will rule on the lung issue and you are going to have to take them to task. The other issues including the heart which by the way should be considered as an aggravated condition from the lung as the PFT'a and the Pulmonary HTN cause the heart to work harder than normal as it has to force blood through the narrow vessels int he lung. The rule governing a pre service disability aggravated by a disease incurred in service is clear. 3.306.

You just need to be yourself and dont allow this issue with the DRO to side track you. Keep on point. You wiull be A OK.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

I almost feel sorry for the DRO. You will do great you know your claim and the regs that support it.

My suggestion is to take a piece of paper and write the names of some of your friends and slip it into your pocket. Than you will feel that you have the support of these friends. It helped me do something I thought was impossible when I flew to Mexico. Your name was on my list.

Veterans deserve real choice for their health care.

Thanks for lending an ear to my vent and all of your support.

Last night I was really getting ready to just do something bad,

but my venting did help.

Now today, I read all of your kind words and I feel a little better.

Pete - thanks for the idea and the honor of being on list.

Carlie passed away in November 2015 she is missed.

Hang in there Carlie. You are there for us and we're there for you. I know it is hard to not let it get to us and it always seems like it's the VA's intent to rattle us. Don't let them win. Concentrate on what it is you need to accomplish at your hearing and get it done. Turn the tables on them and rattle them for a change.
