Thinking I'm Gonna Ask My Doc To Put Me Out Of Work Tomorow.

Question

Ok.

I work as a police officer.

The other day I had an incident at work where I had a melt down in public, in front of the Chief.

A bunch of stuff that was not my fault led up to it and the Chief does not seem to blame me but other on the department do. Now, I don't really care to get into that right now except to say that I had to work 2 extra shifts and had to provide traffic control for several hours on my days off and the pain along with all the other crap just got to me. if I we're not in pain and on alot of meds, I may have been able to handel it differently.

I have never had any dealing with Social Security.

Let me tell you all my issues and then let me know what you think my chances are.

First off....

I'm 33 years old, soon to be 34.

I have the following.

DDD of the lumber spine. (service connected)

DDD ceverical spine. (service connected)

GERD. (service connected)

Snapping Hip Syndrome. (service connected)

Incomplete paralysis/reduced refelxes, arms & legs. (service connected)

8 total ratings of 10% each for a total of 60%.

I am also diagnosed with the following which are being heard by VA now, or soon will be.

Chronic Pain Syndrome with depression.

Insomina caused by Anxiety. ( gonna try to get the doc to link all that to the chronic pain claim)

Mild hearing loss.

Tinnitus.

Neuralgia/Tingling in my hands and fingers and my legs fall asleep.

E.D.

I am diagnosed with...

Mild positional Sleep Apnea. (Not sure if I can claim that with VA)

I am pretty sure I will soon be or can diagnosed with the following.

IBS.

Arthritis. (left wrist and shoulder)

The pain from my hip and back, along with my insomina and all other conditions are making it hard to work. i don't do well witht he public anymore and work night shifts, alone... By choice.

I have not been on the road now for several years and bassicaly have a light duty type of jjob that alot of retired cops do part time.

Based on my age....

What are my chances of getting social security at this point?

And from there... If I can get my chronic pain claim rating fairly... to the 60% or above level, what are my chances of 100% IU?

I seriousley doubt that I can last another year at my job and if I lose it, I"ll also lose my retirement and long term disability insurance.

That's another matter.. The long term disability insurance at work.

Ok guys..

What are my chances???

I"m at my witts end at this point.

Also....

When I file for SSD, do i file on everything I am diagnosed with or just pick the most serious conditon.

I dont know much about SSD and this is some scary sh**.

How much will my 60% rating help with SSD?

I know I"m rambeling but I'm kinda freaked out.

I think you will need one separate rating of at least 40% unless you get 100% schedular combined. That is hard to do.

Thanks john for clarifying that up for me I forgot to add that in.

Gunner, your age will probably be your biggest barrier against you. Your disability from your Police Union will be the easiest to get( if there is such a thing as easy). They will be the ones most in your favor. SSD wuill fight you tooth and nail because of your age. I was 50 when I filed and they fought me hard for 3 years. A friend who was 40, who had basically same physical problems had to fight them for almost 8 years. You at 33, they will look at that as paying you for 40 years. They will be looking for any cracks in your case. They usually try to starve a person out.(No funds coming in). But if you have your police pension, hopefully that will get yo buy for the long fight. So start cutting your budget all you can. The VA will probably jerk you around the most trying to get you to drop your claims. With the state of the country now and in the near future looking the way it does, they will be looking at everyone and everything to cut their budgets.If you tackle all three at once I feel they will overwelm you. IMO, I would go from the easiest and work my way up. That will give you a foundation to build each case upon. You didn't mention whether you had a family or not. That makes a big difference as well. Money will be tight, and each dept of the Government will be dragging their feet. I wouldn't quit your job until you can be sure that your pension from the Police Union is almost in your hand.I wish you well for your about to take a diffuicult journey at a difficult time! Mike

I disagree in this sense. If you don't file for SSA or TDIU you lose your earliest effective dates. As soon as you file your retirement papers from the police file for everything else. Big Red is right that police will probably be the easiest, but you want to file for everything as soon as possible. I retired on disability from the feds. I used the same date for SSD and TDIU. I did not get all monies at the same time but that was the effective date I was awarded for all. If psychotherapy can't help you then file for everything.

How long have you worked for the PD? Is it a municipal or state agency? The reason I ask is if you are in a retirement system other than Social Security

your employer may not be required to pay full Social Security taxes. As a city employee I did not qualify for SSDI because my employer did not pay full Social Security taxes.

The city only paid a minimim contribution that did not cover disability.

If I remember correctly your employer needs forty quarters of full Social Security taxes in the last ten years in order to qualify for SSDI.

I have the following.

Incomplete paralysis/reduced refelxes, arms & legs. (service connected)

The five issues above will be factored into your claim for SSDI, whether they help substantiate your claim for SSDI

very much - will depend on their severity, Gerd won't count for much of anything at all.

8 total ratings of 10% each for a total of 60%.

I am also diagnosed with the following which are being heard by VA now, or soon will be.

Chronic Pain Syndrome with depression.

Insomina caused by Anxiety. ( gonna try to get the doc to link all that to the chronic pain claim)

The two lines above - if SC from VBA is granted, will receive one evaluation under the criteria for MH disability.

Mild hearing loss.

Tinnitus.

For SSDI purposes - the two above won't help any.

For VBA - Mild hearing loss might get SC'd and it would be evaluated at zero percent.

For VBA - if Tinnitus is adjudicated as recurrent it would be evaluated at a single 10% to be combined

with your other SC'd disability's.

I know there is more that followed but I do not see anything at this time that would lead me

to feel SSDI would provide a fully favorable decision, at this point.

I"m not in any kind of "police union".

It is a state department with a benifits package that includes a "long term disability policy". If I understand correct the short term pays 80% of my salery and the long term pays 60%.

I talked to a lawyer the other day who had me call Social Security asd ask them if I qualify and I do.

It may be an uphill battel but it's one I"m going to ahve fight at this point because I won't last at my job.

Gonna see what the doc says this mornning.

May ahve togo to another doc.
