"Test Results in Veterans Medical Facilities " by Jim Strickland

“I'm fortunate to have frequent communications with Rich Cohen, Executive Director of NOVA. The National Organization of Veterans Advocates is a premier entity that serves to educate and inform attorneys and agents who represent veterans. I'm not an attorney and I don't have any legal background and the opportunity for me to vent frustrations as well as ask my questions about all things legal is invaluable to my efforts.

Rich offered this to me recently; "Jim...VHA can't get it right". He attached the report from the VA-OIG, "Management of Test Results in Veterans Health Administration Facilities". Rich points out that, "The report documents the failure of VHA to notify patients of test results and shows that in 48% of observed institutions (10/21); 'Policies did not describe a process for monitoring the effectiveness of communicating critical results to patients.'"

In simpler terms, doctors at almost half of VA medical facilities studied didn't have a good policy telling them when and how to inform patients of test results.”

I emailed Jim that he must have ESP because yesterday I got a VACO response (nothing to do with my claims) regarding an accountabilty matter I have been pursuing for many years and might finally be coming to a head.

It involves a comment I made at the Federal Register and the NPDB mandate.

And the article he posted reflects the points my comment contained. (I think they took it off the Fed Reg site)

A veteran could easily assume that if the VA doesn't contact them about a test result-everything was OK.

But the reality is a test result could be critical and need immediate attention.

I get test results in the mail from my doc sometimes but usually it is the first thing she addresses when I have next appointment.I don't know why the VA is lacking in this important area of patient communication.

I have to have test done befor emy appointmnets because I am monitored every 3 months for my pancreas disease and liver complications,, after a few years of this, this time they had no blood test scheduled for my next appointment, and when I would get there they would have no blood test results to adfjust my meds or send me back to liver clinic.. I tried telling everyone for 3 weeksm I need the test one week befor emy appointment, or else they would have to have them drwnt he same day and send me back a week later... no one listen,, I tried everything to get the labs, everyone just refused to help... I called everyone,, I even went to the clinic, while ther eon other business...

finally someone called me yesterday, Friday, just before 4 pm, after the lab closed at 3:30 and told me they ordered the tests... too late,, now I go monday morning to have the tests 2 hours before the appointment...

the 3 weeks of trying to get the problem corrected got me nowhere... I do appreciate the case nurse finally called, but it was too late...

it's like beating your head against the wall, the wall wins..

Not in appeals, since I got 100%, and some of it was winning an 1151 negligence, which the VA turns out does not give ful benefits if you win 1151 negligence they squirm and legal loophhole you and your family out of many benefits, really crapp nasty bunch running the va benefits, they wil backstab and scre wyou even if you win you lose. May 2021.

Try giving the Patient Advocate a call to help you get this set up. Not saying it will change anything, but it might be worth a try if these people arn't capable of getting their act together. After that, file a complaint at the VA internet site if they still can't do it. Sometimes you just have to get enough heat under their butt to get it done.

If they fail to schedule your lab appointment far enough in advance of your liver clinic appointment, just call the liver clinic and tell them you are cancelling their appointment until the labs are completed prior to the liver appointment. That should get them on the ball.

If its the DALLAS VAMC good luck calling they don't answer the phone.

Veterans deserve real choice for their health care.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
