Bva Denied My Smc For 100% + 60% "s" Award . . .

My atty(I wasn't needed) had the staff conference, Monday. They, the CAVC court clerk, the VA atty and my atty agreed that I probably had a case for an EED on my diabetes claim (w/no cash payment change) and better evidence of HB back in the late 1990's, which my atty feels, at minimum, rates a staged rating for an SMC "s" award, back then. So now I'll just wait until the case is heard. I'm guessing I'll win a remand and a decision by late 2015 or 2016, if I'm still alive. Anyway, I'll be installing a new flagpole to fly my American flag, upside down, for the next 4 yrs!!! And life goes on . . . jmo

Ok..PR...I will bite. How do you "stage" a SMC S rating? You either get it or you dont, but you dont get 30% SMC S, and then 70% SMC S.

Also, why would eed for your diabetes claim NOT change monetary compensation? Usually, if an issue is "moot" then the court so states.

In other words if you are not eligible for SMC S, then it would be moot for you to be 100% instead of IU. However, I recently did get the BVA to admit it "was not moot" if my effective date of IU was earlier than my effective date of 100%.

bronco - Ya got me! I have no idea. Since my HB claim goes back to 1989 and HB is assumed to be permanent, I'm guessing they might award about 10-12 earlier years and then take it away. I think I can still win it all. According to my atty the combined ratings table is arbitrary, with no law behind it. I kinda disagree but we'll where it goes and meanwhile I'll see what I can do to provide additional evidence. jmo

Of course...they would "stage" (Fenderson) rate your SMC S by, instead of awarding it back to 1989, they "pick" a later date. That is going to be hard for them to do, in light of regulations requiring them to infer SMC whenever you meet the criteria. I will speculate you dont meet the "housebound in fact" criteria, and are seeking HB strictly on statuatory (100 plus 60) housebound. However, if you do feel you meet the "housebound in fact" criteria, then it may be a mistake not to persue that as well. I can, however, see an advanatage in appeals for NOT mentioning eligibility to "housebound in fact". That is, if the VA does not consider both criteria for housebound, that should be, at a minimum, a cause for remand to consider you for housebound in fact, even if they deny statuatory housedbound, for example, by trying to combine your ratings instead of adding those over 100%.

A remand always gives you the opportunity to submit new evidence, and have it considered at the beginning of the appeal period (at least that is how I see it)

I dont think there is precedent for staged SMC, BUT, I do know judges have pressure also to "dispose" of the case. The judge does not want lengthy litigation.

Okay, received a letter, today, from my Attorney(s) that they've secured a preliminary agreement, w/the VA, to remand my claim of entitlement to SMC, from the CAVC to the BVA for reconsideration. Now I just have to wait and see what happens. I'm pretty sure it'll be awarded, just don't know how much or how long.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
