Claim Sent Back To Developmental Stage

Question

Hello again family. I hope all has been well. I have just a couple of quick questions for you guys. My claim was filed 05-11. In November it went to the raters desk but was sent back to development due to an appointment for an MRI. I then was set with an appointment for orthopedic eval for surgery. I was sent back to physical therapy after my orthopedic evaluation and the claim went back to rating on the latter part of feb 2012. My questions are. If this claim went back to developmental due to an appointment for an MRI, what will happen if now I am sent back to ortho for surgery (which is happening). In addition, if surgery occurs, will this have any impact on my claim percentage. Ok, one more that hasnt been answered. Can someone tell me if they have been able to get VA doc's to sign their FMLA paperwork? I will be down for about 2 months after surgery and dont want to lose my job. Now if I get 100% then I will not really care about that. biggrin.png Thanks family.

Yes, this surgery could impact on your rating as well as a potential to file for Temporary convalescence compensation. Those regs are here under a search.

Are you service connected for this problem already?

It is a good idea to send VA (make copies and send with proof of mailing) Any evidence at this point that could a affect the rating.

Osceola's response to his people, the Seminoles, was

simply "They(the US Army)have guns, but so do we."

Sameo to us -They (VA) have 38 CFR ,38 USC, and M21-1- but so do we.
