Gerd For Sw Asia Veterans

A fellow Veteran was denied SC for GERD under the new presumptive law for SW Asia Veterans. The VA states in it's decision that GERD is not a functional gastrointestinal disorder, but s structural disorder, therefore the claim is denied. Does he have any recourse or is there an error here by the VA?

Tell him, with VA nothing is ease!

As the va said, GERD is not a disease subject to presumption. To tell a veteran to NOD a case just because ..... makes no sense.......In order for it to fall under persumption it must be one of the listed conditions and it is not.

I am at appeal at the bva now with a claim for gerd/hernia/ulcer. I was treated in Iraq and at the va. Upper gi/EEG tests confirm it. Va denial letter in 2008 says the problem resolved itself, all the while getting treated and more confirming test. Go all the way, don't give up!!!
