Got a phone call today out of the blue from the message it was TTC I think. My hearing ain't worth beans so could have been the NFL draft? Ha ha!

Anyhow I am and have been a 100% disabled vietnam vet and don't remember any claim I sent in except there was an appeal way back in 2006! Surely that can not be it, do you think?

Anyhow that appeal was only for my hearing which the VA has never recognized as related to my military service but I appealed that to the BVA in 2006?

I have been 100% for my heart since back in 2005 is the VA pulling our awards and doing reviews? I am 63 years old and this BS is getting on my damn nerves!

Anyone out there at Hadit hearing anything about this?

Could it be QTC?

If you went to 100% in 2005 for cardiac and the hearing claim was part of that appeal that wasn't decided. They shouldn't be able to reduce you on an appeal unless there is CUE on the 100% rating for the cardiac condition. I don't recall the exact reference but I am pretty sure of that information.

If the examination is for anything else besides an open appeal, I would suggest chatting with you VARO and ask them why you have been scheduled for an examination since you are over 55.

Anyone else on the board please correct me if I am wrong.

Thanks for a reply. Had the wife listen to the message and it is QTC and they said they are sending me a package and I have 2 C&P's to go to!

This sounds like a screw up on their part: 1. I did not put any claim in! And 2. I was granted P/T back in 05 and the only appeal I have for my hearing I checked on ebeniftis site and it shows it as closed and the BVA has notified me! Which is wrong because I have NEVER heard from the BVA.

Haven't been following whats going on with the VA lately basically just taking it easy and trying to live long as I can. I was granted SSDI in 4 months and did it all myself same thing with the VA and P/T but it wasn't easy. I used this board and one other and members helped a great deal along the way!! Now this?? Nothing in the mail today will see what next week brings but I can tell you my anxiety is up along with my BPS!

Just had my third heart stent put in this year on the 29TH of February had another 80% blockage I don't need this right now!!

All of my appeals on eBenefits state pending with the BVA although none have been forwarded yet and they tried to close one out (said it timed out - Hasn't) indicated the BVA closed it.

I had called BVA and they confirmed they don't have anything for my claims and they certainly didn't close anything out. They indicated the entires on my appeals on eBeneftis have been made by Detroit VARO. So one of the few claims information areas I can still see, is wrong!

Well here it is Wed. and I have still not received anything from QTC or been able to find out through ebenefits what these 2 supposed C&P's are for. Usually in the past when they have called I would get a package right away, like in a couple of days.

Anyone been to a C&P lately? Just wondering if you have been notified and when you got the full info.

OK Friday a full week and a day since the phone call from QTC got a FedEx envelope with instruction for a audiology exam. This is the very first time a C&P has been ordered since 1983!!

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
