Question

I just got back from a ratings exam at the Phoenix VA with a ratings Doctor. Is this the last step in this long ordeal? Really want to hear from others that have already been there? Seemed like all the info he entered into the questionaire/ Survey in the computer favored my claim tremendously....OR.....is this gonna be another stop alongthe way in this already 6 year journey?? any info is appreciated Thanks

I have a repeat C&P exam at the same VAMC in Phoneix in a month. They are having me redo one exam due to the C&P exam Doc used the wrong DBQ form on the computer for my exam urggg. So they are making me come back to repeat it again. Bad enough this is the third time cause the Phoenix VARO said my C&P exams in Pennsylvania back in Oct 2010 were inadequate. Did you get seen in the Topaz clinic downstairs or a speciality clinic? The Doc that messed me up back in June was in the Topaz clinic a retired USAF heart Doctor (very old guy). Today is my 2 years anniversary for my inital VA claim after retiring from the Air Force and I filed on Sept 28 2010 the day after retirement. So hopefully you will have a better experience than me 730 days and counting. Atleast they rated me on 2 out of my 4 contentions 2 months ago so atleast I have some rating two more to go. Hang on brother it's a long road but it seems the Phoenix VARO is beig very carefull and dotting there I's and crossing thier T's but you say 6 years wow?????. I have to say the 2 they rated me on they were dead on with the rating so I hope you will have the same luck on the first round.

Sounds like I went to the very same Doc you did.(Topaz Clinic)....I hope thats not gonna be a bad thing? (Can only hope and pray he's learned from his mistakes) I filed a NOD in 2009 after being denied, Ive been to several doctors and specialists at the VA and was hoping this would be the final hoop before getting a rating?? It seemed to go very well as far as what the Doc entered into the computer??? Was he the one who actually decided the extent or percentage of your rating? or is that decided by a board later?? What exactly is the point of the ratings doctor seeing you?...to evaluate how effected you are by your ailments, I assume?? Thanks

The C&P examiner is just there to give you an exam according to the DBQ form for the ailment your claiming. He sees your paperwork the VARO sends which usually is not much and does the exam they instruct him to do. He doesn't rate you at all all he sees is your objective evidence, physically what's wrong and report it. Then they send it to the VARO usually when they gets pestered enough by the VARO cause it late 30+ days past the request. The rater takes all the paperwork you submitted, the Dr's observations how bad you really are, your SMR etc and according to the 38 CFR fro what I see and give you a rating. If the Doc messes up it really hurts you especially for guys needing ROM measurements etc. I even sent in several IMO's from my Phoenix area Urology and Spinal surgeons which were very well done and they still made me take the stupid C&P exams what a waste of time and taxpayer money. After the last set of exams it took about 1 1/2 months and I had those two decisions and they deferred the other two so hopefully you will hear something soon. Message me if you don't mind and let me know which one you had, I just sent you a IM with the Doctors name for the C&P clinic.

You might have a decision in about 2-12 months.

manning....believe it or not that Dr (very old guy) is 90 years old. I see him just about every time I had a C&P exam. One thing I learned from him is, if he wants to hear you talk, it better be just the answer of the question he asks, or else you'll just as well talk to the walls. Although he's old school in his mannerism, he also knows what it takes for higher ratings. I've had 4 C&Ps with him and each time ended with a higher rating. My last one ended up 100% IU. Don't let his age fool you, he really is on top of the game.

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1.       The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
