Four Calls And Four Different Answers

I won't make this long winded. I have a claim for TDIU since August 1st. Took the C&P exam in Jan 2013. Exam ID'd worsening lower PN, and ID'd upper PN. Lower PN at moderately severe from mild. Upper PN found at moderate. Closing statement very good, stating "these conditions renders him unable to secure and maintain gainful physical employment. It is also very unlikely he would be able to secure or maintain gainful, even selective, sedentary employment". Since August I have received 4 letters from Indpls telling me they are still working on my claim. Then I get a request for additional information and another statement in support of my claim from Togus, Agusta ME. They have my claim. I have called a total of 4 different times to the VA and they tell me a decision is forth coming. When I ask where is the claim being reviewed at? Two said Indpls. And two said Agusta ME. And when I called my DAV office which is in the same building as the RO, they thought maybe ME. It is pretty frustrating at this point when you have done everything ask to do, and your claim is bouncing all over the east coast. Who knows, half may be in Indy and half in Agusta ME. Anybody had this happen, and any opinion on results of C&P? Thanks.

Time to be patient. Sounds positive to me, especially w/the claim only 7.5 months old. Sit back, relax, plan your upcoming vacation, whatever, just to keep you occupied, for now. It shouldn't be much longer . . . maybe 30 days, maybe 90 days . . . just relax! jmo

You might want to try IRIS ( The Main VA web site Contact US button) and ask for a status and where the claim actually is.

Or maybe better yet...are you enrolled into ebenefits?

I know how frustrating this stuff can be.....

The C & P sounds very positive regarding the PN and how it hinders any potential employment.

Only question I have is , is the PN being associated as secondary disability , to any established SC you now have?

Did the C & P doctor make that point too?

sometimes when a VARO reaches a high % of undecided claims, they farm them out to VARO's with less % of undecided claims. If you receive a request for additional information, you will find a VCAA Notice of Response Letter in the packet. Make sure you get this back tto the VA. When VA sends the first of these packets out requesting additional information and receive nothing, they have to hold this claim for 90 days and send another request. Then after the second letter they have to wait another 30 days. So it's in your best interest to respond when they ask.

You can always send them a VA FM 21-4138 and tell them you have nothing else to provide and please render a decision on your claim as soon as possible.
